After being Laid Off question....

Hi, I was laid off from my work as a warehouse operative 7 months ago because of financial cutbacks (I was with them for around 9-10 months in total) and now it has come to my attention that someone has now handed their notice in, so inevitably they will more than likely be advertising the vacant role in my old position of Warehouse Operative.
My questions are thus:

- Do I have any rights to that job automatically as it has been under a year since my lay off?
- If not do I have any rights to that effect as it has been less than 1yr?

You have no automatic rights to a job, ever, after being laid off. Not one day, yet alone one year!
You have no rights at all, as you were there for less than 2 years (except for protection from dismissal on the grounds of a protected characteristic)0 -
If the reason for being laid off was genuinely because of financial cutbacks you should be in a very strong position if you reapply. You could try contacting the company to see if the role is being filled. They may simple expect other staff to absorb the workload. Many companies don't fill every post when somebody leaves. In the situation with your previous employer, I suspect they will try to save money by not replacing leavers. Company financial problems tend to take a long time to resolve.0
