Hi Guys,
Im not sure if this is the right thread to post this on.. but here goes.
So BW legal have had my account since the end of 2016, I raised a complaint with them, they investigated and responded. However they made an error and never put my account back into proceedings.
Its not until I attempt to get a mortgage this year, I get a call from the bank explaining about there is a default on my credit file from BW Legal, an it will have an affect on my application so they said not to do one.
in the mean time i had forgotten about the account, and I understand there is some liability on my behalf.
BW legal explained that there was an error on there behalf and when i received the final response, 14 days after the account should have come out of being on hold.
I then phone up and they said that it should have gone back on the 1st January 2018. However I phoned up on the 15, the same day they realise the error and the account has gone back into normal proceedings.
I am really not happy, and I feel they have not only ruined my chance of buying a house, but with any chance of me getting my credit rating better has been ruined by me not being able to pay the account in full, therefore showing as a settled account. Its been in default a lot longer than what it should have been.
I then phoned up to complain, and essentially was told I would have a call back on friday just gone, however I had to phone today (monday) for a response.
The facts are
- I do owe the money
-They left my account on hold by accident
is there anything I can do or anyone I should contact for advice?

It is your failure to pay your debt that is stopping you from getting a mortgage. Once you repay what you owe, and demonstrate you are able to maintain your financial affairs, you'll be able to buy a house.

I’m confused. They have defaulted the account, what does the account being on hold have to do with the default? Are you trying to pay it so it will become a settled default? Will the bank be okay with that have they indicated? Why didn’t you use some of your deposit money before it went into arrears to pay the debt off? It may cost you more in the long run with higher interest charges0

I’m very confused. BW Legal are so-called solicitors so what is the account default to do with?0

They put it on hold whilst they investigate. Not removing from hold most likely is not detrimental to you. It probably means they didn't start their normal legal process. What was the outcome of the complaint, I assume by "put my account back into proceedings" that it was rejected?0

BW Legal are well known on the parking tickets board - You might get some useful info about their methods there.0

BW Legal are a specialist debt recovery law firm.
They act on behalf of their clients, they do not buy debts.
Therefore they would not be able to put a default on your credit file, only the original creditor, as the owner of the debt, can do that.
