Defaults and CCJS whilst I was in hospital

Please help,
Last year I had a really tough pregnancy and was in and out of hospital with pre eclampsia. I had an emergency ceserean 10weeks early and my son was born and had a long stay in the Neonatal intensive care unit.
He was born in June 2017 and this put a huge pressure on us financially.
My credit report has gone a mess and I have
Defaults dating from May to September 2017 and two CCJS stemming from these defaults, dated October and November 2017.
Because of my circumstances could I get these removed? I did not receive default notices in the time period to sort it out as I was in hospital myself poorly or I was at my sons bedside.

    Hi,

You can apply to the court for a setaside application.

    However, you must :

    (A) Have a defense with a reasonable chance of success.

    (B) Pay a fee of £255.00 per application.

Although remission on the fee`s is available for those on a low wage.

If you admit the debts are yours, and you have no other dispute, then you would be better off accepting whats happened, and agreeing repayment in line with your circumstances.

In the nicest way - no I very much doubt it... As it is a true reflection of your credit history.

I'm sure throughout this time you still opened your post? Knew what you had in the bank? Saw what bills where being paid or not paid?

The best thing you can do is setup suitable payment plans and pay off the debt ASAP. Then work on building your credit history again, pay loans/cc's/phone bills etc on time.

The Defaults and CCJs will be on your credit file for 6 years unfortunately. Again ensure you pay these, the creditors could take it to court for further enforcement.
  • Thanks for the reply.

At the time I was very poorly in hospital for months and contracted sepsis shortly after having my son, he was in the Neonatal intensive care unit for 8 weeks and I didn’t leave his bedside at this time. Post or bills or anything had no relevance as we thought he would not make it.

Thankfully now he is a 7 month old doing well :)

I was not aware I had received the default notices at the time and once I actually went home and began dealing with things it was too late to rectify.

I could suck it up and leave the report the way it is. Just so disheartening as 2 years prior I began rebuilding my credit history and had a good report. Now it’s awful.
