Unused Holiday Pay

It has recently come to light that none of my holidays have been allocated in my work place and I am unable to use the rest of my holiday entitlement.

I haven't used any of my 6 weeks holidays, however I was under the full impression that by October the 1st they would automatically be allocated as it states so in my companies policy that all but 1 week would be allocated. We are encouraged to book them so its a bit of negligence on both of our part, but the fact that its in our policy and the peoples department has failed to allocate my holidays I'm not sure what to do.

I've spoke to them and they said it's basically my fault and are making out that I'm going to lose 2 weeks of my holiday entitlement.

Any thoughts or opinions would be great! :)

    When is the holiday year?
  • Usually I agree with the use or lose policy, however it specifically states in my companies policy that they are to allocate it. They have done so with many colleagues that I have spoken to I seem to be the only one that they have failed to do so.
    They run out in the 1st of April and so far I have manged to book 4 out of 6 weeks off so far.

    Ours is this above, use it or lose it. Maximum of one week can be rolled over into the next holiday year.

    Bit foolish of you to not book any holidays thinking you'd get all of them booked for you...I wouldn't take that chance.

    I think given that the company policy is that they will allocate dates for you to take the holiday, it would be reasonable for you to ask them to either do that, or to agree that you can roll the time over (perhaps they could allocate the 1st 2 weeks of the new holiday year, to get it out of the way?)

    Or agree to roll over 1 week and pay you for the other.

    Plenty of time to take the holiday keep pushing and keep good records if he company refuse to let you take them or carry over.

    There is a court case where payment for unused holidays going back years needs to be made on termination, depending on how that gets resolved you may have comeback.

    They can only pay allowance over statutory.

    You have booked 4 weeks and still have plenty of time this holiday year to book the final 2, put in a request and if it's refused then ask them when you can take them, they must by law let you take at least 5.6 weeks (inc bank hols) during the holiday year. Any holidays over this are contractual so you need to read your contract carefully.
