whats the best way to go about this quite long sorry!

i will soon have 3 children when 3rd one pops out. my eldest is 4 next month and has a diff dad to the other 2.
when my eldest was about 1 i took him through csa as hes one of these fathers that uses my son as a toy infront of his m8s,bothers when it suits him not my son and wouldnt ever change a nappy, you with me lol.

it took weeks for an outcome of csa in the end i recieved a letter saying because my sons father earns £100 or less a week i would only get £5 a week!!!!!

to my shock and amazement i coudltn believe this.
my sons father is a joiner and can earn anything from 200 to 400 a week (ive seen the wage slips) so how did he manage to lie and get on this one saying he earnt 100 pound or less a week when i no fine well he doesnt.

anyway moving on he started getting in arrears believe it or nto for £5 a week so i was recieving something like 9.54 a week BUT only for 5 weeks then nothing.they chased him etc..in the end we both came to an arrangement that we would do a voluntery agreement of £10 a week (he says its all he can afford as hes in debt loans etc but still lives at home with his parents) after not being able to get in touch with csa for weeks months on end i left a message and left it as that.and now absolutley nothing from csa but the agreement between me and my sons father is still on going.

but one thing in also dont get it as he works a week in hand if he doesnt work one week or gets very very low pay my son doesnt get a penny should this be the case??

ive come to the conclusion that he really doesnt want to pay but knows he has no choice so hes lied to inland revenue about his hours and only declaring being paid so much as hes self employed thats how he managed to lie to csa.

i wouldnt mind if he was a proper dad to my son but he isnt which hurts to see my son turn round and say he hates his own dad.he has a responsibility for his welfare.

what do you think i should do about this??

thanks in advance

    Hiya, again!

This is similar to my situation, 'cept my son's dad is 22 months in arrears and the CSA have yet to do anything... He's also claiming to make less than £100 / wk YET the rent on his place is £500 / pcm - doesn't add up, eh?

I'm having oh so much fun - NOT - dealing with the CSA. 2 written complaints in so far. First one upheld and dealt with because my MP got involved. Second one is past resolution date, so MP to get involved again.

Have you been in touch with CSA and told them you believe the assessment is wrong and asked them to look into it again?

"IF YOU THINK THE ASSESSMENT IS WRONG

If you think the assessment is wrong, contact the CSA in writing or by phone and ask them to look at it again. If you are still not happy with the assessment you can appeal to the independent case examiner. The CSA leaflet A guide to changing & appealing against child support decisions tells you more about appealing against a decision." [from Lone Parents Support website: http://www.loneparents.org/modules.php?name=News&file=article&sid=9&mode=thread&order=0&thold=0]

Do you know when assessment was done? Old rules (pre-2003) or new rules (post-2003)?

    You could try:

Tells you what you can do if you don't agree with a decision we've made. It explains your rights, how we handle an appeal and what happens after a decision has been made about your appeal.

I'm stunned by them saying they couldn't look into it!

Self employed are notorious for this - my ex was the same and I had to apply for a Departure on the grounds of LIfestyle inconsistent with declared income which was refused, so I appealed and won. The only problem here is that you need a lot of evidence - if he has lied to the Inland Revenue, you may want to notify them so that they may wish to launch an investigation. My ex is a builder and said he earns less than £150 per week, yet the average pay for such a person was more in the region of £90 - £150 per DAY. He was trying to say that he earned on average £20 per day which is totally rubbish.

What evidence do you have? His loans are totally irrelevant as to whether he should be paying more - if he earns it he should be paying as CSA is a priority over other debts.
