Annual Leave and Pay

Hello All

Sorry if this a relatively obvious question but have only ever been on a salary and always had bank holidays off, I am not sure...

My husband works in transport (six months in) They are paid on a hourly rate. weekends and bank holidays is a higher rate of pay compared to normal Mon-Fri.

He has had a weeks annual leave from Sunday 24th-Sunday 31st Dec. His rota would have had him down to work one weekend (Sat and Sun) and the two christmas bank holidays.

Would/should he be paid the higher rate for these days as he would if he was not on annual leave

I will check his contract but I'm just trying to budget the pay for next two weeks...he is paid weekly in arrears.

    Unlikely, normally you only get the additional pay if you actually work the unsociable hours.

    Right ok. That does make sense. I read somewhere (Google search) that you shouldn't be 'out of pocket' when taking annual leave. The two bank holiday days they were closed too.
    Oh well, joys of the industry.

    Yes you're right, there was something not too long ago about paying some leave at normal pay levels rather than basic pay levels. It's complicated but for shift workers you should get the average of the past 12 weeks, but only for 4 weeks of leave.

    The 4 weeks would only apply where the remunerations is part of that ruling.

    For normal working, normal pay(inc enhanced rates) the averaging should apply for all 5.6 weeks as that is how the UK law is written.

    My last job had provision to be paid weekend enhancements when on A/L, so not unheard of.

    I did this issue with the link is it is a condensed summary.

    The cases involved were mainly about payment like overtime and commissions.

    UK legislation "weeks pay" is what holiday pay should be using already has provision for different hours at different rates that applies to all 5.6 weeks.
