CCJ debt is not mine

I'm looking for a bit of advice; if anyone else has a similar issue that they've resolved or know anything that may help?!

I received a CCJ in August for an debt with I have never seen on my credit file before. Initially I assumed it was a scam because I didn't recognise the debtor and the CCJ didn't appear on my Experian.

Turns out it was real :mad: however the original debt was for TalkTalk, an account I've never had before!
After looking into things I've found out that a family member opened the account out in my name without my permission!!
I don't want to pay the CCJ because that means I'm accepting liability and on principle I don't want to do that, but it's really REALLY messed up my credit. Plus I'm a student so I can't really afford to pay the debt anyway.

Does anybody know what can do about this? I don't feel like I should have to pay this but I can't have this CCJ sitting in my name ... it' had such a negative effect that I can't even open a student bank account :(

  • Contact the police and report the fraud telling them who it was that opened the account.

    I would also explain to TalkTalk and hope that if the police prosecute, they may agree to it being removed although I am not sure if that can happen or you will have to pay for a set aside which will need paying for.

    I've highlighted part as I am not sure if a company can retract a CCJ.

    Report as fraud, (police and action fraud).

    Unfortunately the only way to get rid of the CCJ now is to apply for a set aside.
