Unpaid Wages - Tax rebate

I'm not sure if to post twice. Unpaid wages and a tax question.
1)My agency has paid my wages into a closed bank account I used to have which they still had on record. I gave them my correct bank details at the beginning when hired and filled in my timesheets correctly and submitted on time, but they used the old account. Long story is the agency say they won't pay me until the payments bounce back or I prove the account is closed, but the wage slips make it more confusing. My bank says they would not be able to see any attempts to pay this closed account.
2)Over the weeks they processed my tax code from emergency tax to my regular tax code and this week there is a large tax rebate for no reason. I'm not worked for this company for that long so why would I get a tax rebate from them. I just want to make sure they are not using it for

Paid as follows
Week 1) Worked 24hrs for £240 gross
No pay slip provided - Payment sent to the old account

Week 2) Worked 35.5hrs for £355 gross
Payslip shows paid for 24hrs+35.5hrs - Payment sent to the old account. NI number is wrong. OT/X taxcode, Tax taken £119.00, NI £33.72 and a manual reduction made of £160.00 which they said was because they had paid me that the week before.

Week 3) Worked 8 hrs for £80 gross
Payslip shows paid for 24hrs+8hrs- Payment sent to the new account. NI number correct. S1150L taxcode. Tax taken £0.00, Tax rebate £339.50, NI £28.80, manual deduction £108.20

I cannot explain how they got these figures at all. Using online tax calculators has not helped.

1) If the payments never bounce back and I can't proved the account is closed(Bank gave me a statement showing the account transferred without stating closed) what can I do getting my money. I gave my details and they sent my money to an account that's not mine. Why should I have to suffer
2) Can anyone explain whats going on with this tax rebate and 2nd deduction.

    If the wageslip that had the correct taxcode on was the one with the rebate then the rebate was from previous employment or previous unused tax allowances. I assume you provided a P45.
    It is possible the wageslip with the incorrect NI number may cause a later correction where you pay back some tax they have incorrectly rebated but that is impossible to work out from the information supplied.

  • Have you actually checked that the money hasn't fallen through into your new account? Banks will automatically forward payments for a while.

    I would say its their problem re the wages. Theyve paid you to the wrong account pure and simple. They should be taking the hit if any losses arise, ie they should be making an additional payment to the correct account and then hoping the original gets bounced back. Id be contacting them that i would be holding them liable for any charges incurred as a result of non payment which would hopefully hurry them along.

    The numbers are just that, numbers, they dont mean much without context, if you dont know the context, we've got no chance. I cant work out why they are doing the first deduction never mind the second.

    You said agency, im not au fait with them. Do you pay a portion of your wage to them as a result of them finding you work?

    I did not provide a P45 so I think yes the tax office gave them details and instructed them to do the rebate.

    The money did not get forwarded to my new bank account and the bank said they don't have a holding account for things like that.

    I don't pay the agency a fee. They collect that from the employers I am sent from, but I am paid by the agency

    I spoke to the lady at payroll but she was confused at how the numbers had come about and briefly mentioned because it was a manual payment they deduct 66% of the gross, but none at that really made any sense so after Christmas they will look into it. Hopefully by then the missing payment will have bounced back from my old account.
  • If you have given the correct information when you first started, how have they paid money into an account they have no knowledge of?

    Something similar happened to me at university, I switched student account, but didn't give SFE enough warning, and the money went into the closed account. The money should have bounced back to the Payee (in my case it didn't, and the 2k was sitting in the supposed 'closed' account.
  • They paid the money into my old account which is closed which they had on record from when I worked for them several years ago. I contacted my bank and they said it should bounce back. Maybe I should ask them if its there lol.

    In situations such as this, it is usual for the paying bank to initiate a search for the money as it possesses the relevant transaction numbers.

    If you closed the old account whilst overdrawn the money will probably have gone to reduce the indebtedness.
