Help needed with returning something to Asda

On Saturday I went to Asda and just inside the entrance were a couple of tables covered with electrical items. There was a sign saying 'sold as seen'
and when I asked the sales assistant what was wrong with them she said they were just ex-display and may have bits missing, no boxes or instructions etc. I picked up a Tassimo coffee machine and although there were a couple of bits missing (the lid and the cleaning disc) I thought it was a bargain at £20.

Unfortunately, when I got it home and plugged it in it was completely dead. No lights no noise. Nothing !

Should I be able to take it back and get a refund ?

Thanks in advance for any advice.

as far as i've always heard, asda are always very customer focussed. I would return it and basically point out that it doens't work full stop and would like a refund. I understand sold as seen means you get what you pay for but i've never known it to mean something that dont work. give them a ring and explain it to them and get a name for you to quote when you go into store
  • an electrical item shouldn't be sold like that by a major supermarket . i'm very surprised as asda had a policy of not selling the electrical display items at one time.
i'd point out that you are now worried about the safety implications of buying an electrical item that hasn't been tested and could be unsafe

IIRC (and I may be very wrong) but 'sold as seen' has no lergal standing. I know the Sale of Goods Act states that an item 'must be fit for the purpose it was sold for' which in your case doesn't apply as you can't make a cup of coffee!

I was amazed at Asda's policy when I returned some carrots, so go and talk to them.

Yes - take it back - but have you checked it's not just the fuse in the plug.

May be worth checking if you want to keep it - if not, take it back.

My daughter works for asda and they are so easy going they even let the thieves nick clothes and take em straight to the George counter to get refund vouchers as the security is rubbish, so I'd say you'd have no problems!
