1 Months Notice

Hi all

Quick clarification on my notice period

Assuming my medical for new job goes ok tomorrow, i will be handing in my notice here on Thurs 21st. Contract says 1 months notice, therefore my last day would normally be the 21st Jan, but as that's a Sunday, is my last day Friday 19th, even though that's not then a full month?

I assume the fact it's Xmas and we're all off for a week has no influance either? As i'm actually only going to be working 3weeks after handing my notice in

    It really doesn't matter what randoms off the internet say, it's only what you and your employer agree to that's relevant.

    On the basis that a month means a calendar month, and not some other definition, possibly involving working days, then your assumption isn't unreasonable. You'll be employed until Sunday 21st January, but your last day in the office would be Friday 19th January.

    When you hand in your notice, I would ask them to confirm they agree to this, or seek to agree a mutually acceptable date - Friday 26th for example. I would hope your new employer wouldn't have too much of an issue with you starting a week later for example...

    Managed to catch HR and confirmed 19th

    I'm sure the new employer would be fine, but it's these pushy recruitment agents that like you to start quick, he was today asking me if i could start 2nd Jan, even though i'm not in after today, so theoretically giving no notice whatsoever, they're as bad as estate agents
  • AIUI if your contract says one month rather than four weeks, then that's what you give - one calendar month. Supposing you hand your notice in on 21st, your last day of employment will be 21st Jan even though it's a Sunday, and they should pay you/work out your holiday entitlement until then even though your last day "in the office" would be 19th.

    They really are.

    I don't do recruitment, but our recruitment people bill clients on the first day that the candidate starts. Probably has an influence!
