facing dismissal for misconduct

    The fact that system logs can show the limit of your access was to enter information you were supposed to enter, albeit on the wrong system should show that there was no intent on your part.
    I would hope that it would lead to (at very worst) a warning for accessing the wrong system. I would actually argue that as your card should only have permitted access to the correct system, you had no reason even to think about which system you were in.
    Fault, such as it is, really lies with within the admin area who wrongly programmed your new card.

    If what you say is right, then I don't see that you have a problem. As I suspected originally, it sounds like the trust inadvertently(!) gave you access to a part of the system that you should not have had access to. Outside of your control and not your fault. Hopefully that's how they'll see it.


    Irrespective of the outcome, you still need to discuss the issue of your brain tumour with your employer. (Even though it sounds as if that had nothing to do with the alleged misconduct).
  • Yes, I agree. The only way I would refer to your tumour is if they start nagging you for not logging off the minute you realised you were seeing things you shouldn't, since it is possible your tumour may have slowed down your reactions and/or led you to doubt that you were, in fact, in unauthorised parts of the database. THEIR fault, not yours - and of course they have to hold an investigation but it is likely to be another employee who is disciplined.

    I really can not see how this could even trigger a disciplinary, never mind dismissal.

    You were in the correct patient record - not snooping around your neighbour or family member health record.

    Access you had should have been limited by whoever issues systems access cards in your place of work - should only allow you to see what you are supposed to see.
