Ccj help please

I received a ccj claim against me today for £1750.
I’ve been searching for advise online and I’m so worried about a charging order statement I read on a debt site.
My husband owns the property , I am not on the deeds or mortgage at all, it’s solely in his name. Can they still put a charge on the property if they refuse my offer of instalments? I can’t afford to pay it in one go.
I’m going out if my mind .

    No they can’t.

    I am proposing £30 per month instalments. Do you think they will accept this on the amount I owe? It will be tight but I can manage it.

    Ok, let’s calm things down a notch.

    You make your offer of payment based upon what you can afford, supported by a copy of your budget as evidence.

    Charging orders can only be made against homeowners, if you were a part owner, then a simple restriction would apply, as you are neither, these options are not open to your creditor.

    So stop worrying.

    It sounds like a claim, and £30 would clear the debt in 5 years so yes it's at the bottom end of a reasonable offer if justified by the income and expenditure.

    we can look at the income and expenditure if you want to post it.
  • It is my debt. It’s a capitol one card I had and then fell behind with. I buried my head on the sand over it all and now it’s got to a claim. X
