Fired for having second job?

    Less than two years service, you have no recourse unless the dismissal is for reasons related to a protected characteristic (it's not).

    There are plenty of reasons for dismissal other than 'protected characteristics' where the '2 year rule' doesn't apply.

    Surely if the unpaid two hours brings wage below statutory minimum, it is not lawful?

    Yes, if they only pay minimum wage but make attendance of meetings compulsory and then don't pay for that I would argue that they are in breach of NMW legislation.

    In this instance I'd report them to HMRC and then move on tbh.

    For Zero house being dismissed for having another job could come under exercising a basic right.

    They need to get the reasons in writing because the employer has messed up if they have said it is because they have another job.

    If they really just said we need better availability
    'You should be here 6 days a week working part time'

    Then that makes any claim even harder as it just implies a restriction on the ability to turn down work.

    It may be that this is not really a Zero hours worker contract but may be something different like an employee with no guaranteed hours.

    Not sure it is worth the bother, better out of the place and time best spent looking for other remuneration options.

    I started working on a zero hour contract in a bar last month to make ends meet. My manager told me I can pick and choose my hours as I please as it's a zero hour contract. I told them during the interview that I have a second job and they were fine about it. I however was fired last night, for no other reason than 'You should be here 6 days a week working part time' when this was never agreed nor even mentioned during in the interview or at all. I believe another staff member has also been fired for the same reason - as she has another job somewhere else.

    This is the same bar job that demands 2 hour staff meetings once a week, these are held at 10pm and are completely unpaid. Are they allowed to fire me on the basis that I have another job? They covered themselves by saying 'we might give you some shifts in spring next year'. My assistant manager then began to get vicious - saying the managers voted to fire me as a whole and that I missed training because I was ill - which they have held against me despite getting a doctors note. She told me everyone knew I would be fired tonight before the shift, and many of the bar members were being incredibly rude and snappy with me throughout the evening.

    The whole thing seems off, I'm pretty upset by it and needed to vent. Can someone be fired for having a second job?



    YEs they can.


    And since you're on ZHC, you can be 'fired' at anytime for anything.

    You can bring an automatically unfair dismissal claim on a zero hours contract if the reason is the enforcement of an exclusivity clause. However without a written contract you can't prove it existed, that's the problem you'll have.

    It might be worth ringing ACAS, though.
