    Thanks for advice everyone,

    It turned out bill was less than they had estimated by over £50 which has helped and so pleased to have cat home, have to take him back in a few days - wonder if that'll cost????

    Have picked up the court pack today so another step closer and preparing my letters to the creditors today, wanted to send them off at the same time as i cancel DDs etc.
    Bit of an emotional rollercoaster at the moment one minute feeling relieved and that we can finally see a light at end of tunnel and then feeling terrified
    I guess you have all felt like that on here.
    Trying to make sure i edge forward each day.
    We love what we are doing and we love why we're doing it!!

    I think we all felt a bit emotional and like we were on a rollercoaster, at least, with the help of this site, you know what your doing and what your letting yourself in for.

    I read this as that you are sending out letters to your creditors prior to going BR? What happens if your court case gets cancelled and the next app is in 5 weeks time?

    If you have got your court date set:

    1. Cancel all DD (put up with the letter and phone calls ((or avoid)).
    2. Go BR.
    3. Then send letter to creditors or let the OR do it.

    I agree with stubie, why waste your time and stamps. Anyway if you don't have your BR number yet creditors will ignore the letter and contact you anyway. Just ignore the phone calls for now. I haven't answered my phone before 9pm for 2 weeks now!

  • I would have just used the credit card personally

    Dont tell your creditors that you intend to go bankrupt. Let the OR deal with that and cancel the DD's now

    I agree...if you send letters off to your creditors now saying your going BR it'll only increase the calls/hassle from them

    Best to leave it to the OR once your BR (afterall thats what you pay the fees for) meantime if someone does contact you after BR just tell them your currently BR give them your case number the date and the court name you attended..problem solved! & money saved on stamps that you could use elsewhere :D

    Thanks for the advice everyone, i was just following the advice of the CCCS who said to offer a token payment of £1 to all creditors including my debts (i am not going bankrupt at this stage just OH) to keep them happy while we get the money together to file. Saying that the living expenses form they have sent us does say we are saving for bankruptcy on it.

    I haven't sent any forms off so can i just clarify that your advice would be to cancel/stop paying the debts and then just wait until OH has gone bankrupt?
    and what about teh debts in my name (one being a joint debt) should i send them a letter now with soa and offering a token payment?
    I'm confused now:confused: (doesn't take much lately), trying to sort this out, daughter being bullied at school and trying to keep a cat indoors for another week who really doesn't like being kept in.

    This is what I did but yours might be slightly different?

    1/ Opened new sole bank account in OH name only.
    2/ Got court date.
    3/ Transferred all essential DD, like water, elec, etc
    4/ Stopped paying all my creditors, 4 weeks before court date. I did not notify anybody of my intentions. Loads of phone calls though.
    5/ Included joint bank account with OD in my SOA. I am aware that this debt might get transferred to my OH. Although I have heard that it may be included in my BR.
    6/ Not paying my creditors for 4 weeks helped me get the money together for BR.

    I think you are trying to hard to get two things done at once here. If your OH is going BR, concentrate on that.

    Have you posted your OH SOA on here yet?

    I think you are right i am probably trying to concentrate on too many things, we have the court papers and its only a week waiting list so hoping to phone up next week to book the appt for early the following week if i have had the new bank account details through by then and transferred the DDs. OH suffers depression and anxiety hence me trying to do everything for him and why we are in this situation in this situation in the first place and i'm trying to keep it as unmessy as possible so that he hasn't the anxiety of the phone ringing or letters from creditors coming through the post hence trying to smooth things with them in the interim.
    I haven't posted OH SOA because he has asked me not to.

    Thanks for everyones advice, we are hoping that by by doing this it will give OH a breather to start focussing on his health and make big strides in getter better.

  • Hi Peter Pan,

    I can't help you with your situation but just wanted to say hope the cat is ok - mine went missing last week the reappeared a little worse for wear and had to have her leg amputated :eek: .

    Fortunately we are insured (and she is recovering well) but it would have cost £450 and we still have check ups etc to attend although they didn't charge me last week for the post op check up. Some vets take payment direct from the insurers so this could help to if you do get insurance and have problems in the future (although ours doesn't so I had to pay and am in the process of filing in the forms to claim back)

    Not sure where you live but where I am if you are on certain benefits the PDSA have their own vet centre where they will do ops for free so you don't need to see your own vet at all.

    Also I would say you obviously need the money now so do make a claim on the PDSA fund - if you find yourself in a better situation in the future could could always make a donation to pay them back if you feel the need.
