I'm confused!

My partner is currently paying maintenance for 1 child from previous marriage. He has been re-assessed after being off work due to heart attack where he was only to pay £5 per week as he was receiving SSP. He has now returned to work - hence the re-assessment.

My question is - when being assessed do the CSA take into account overtime although it is not consistent or guaranteed?

    It depends on how often he does it. If he does the odd bit, then no, it isn't counted. HOwever, if he does it regularly then yes it is.
  • Okay, so how regular does it have to be to be counted? The nature of work means it can be very sporadic and can depend on the weather etc..

    How is a case re-assessed? He wasn't asked for any payslips. Would they have gone directly to his work? How many weeks worth of pay are counted in the re-assessment?

    Questions questions but I used to work for DWP (in an HR role and not for CSA thankfully) but know you could phone 5 different people and get 5 different answers!!

    They will ask for either 5 weekly payslips or 2 months to work out the average. If in that time there was overtime which was a rarity then they will look at another period either immediately before or after the relevant period.
