Not working notice period

My last employer refused my request to leave without working my notice due to workplace difficulties with an utterly incompetent boss. Who was off on leave and due back the following Monday.
So I dropped a short note to HR telling them that I would have no choice but to instruct my solicitor to proceed with the legal action we had discussed as a last resort due to the total failure of the employer to resolve or even manage the issue in line with their grievance/disciplinary procedure.
Very shortly after I got the call - You can leave on Friday..!
HR probably needed some legal training....

It might be possible to negotiate a shorter notice period, but a shorter notice period and being paid for the full 3 months is possibly unrealistic.0

Well done on answering the question that wasn't asked....My last employer refused my request to leave without working my notice due to workplace difficulties with an utterly incompetent boss. Who was off on leave and due back the following Monday.

Focus on your health. Talk to the GP asap and if you're signed off sick, then you will get something. I very much doubt they will pay in lieu of notice as there doesn't seem to be any reason for them to do that, although they will probably agree a shorter notice period. However, if you take that and don't get a job, I don't think you'll be entitled to JSA (? I'm not too sure about that)/Debt 1/1/17 - Credit Cards £17,280.23; overdrafts £3,777.24
Debt 5/1/18 - Credit Cards £3,188; overdrafts £00 -
Very sorry to hear this . The o p must have a managerial / head of dept situation ? ( I’m guessing this because of long notice period)
As you seem desperate , If I was in this position I would work 1 months notice max and not expect to be paid any more . Health comes first , and no job is worth topping yourself for .
The reasons I would give an earlier exit would be a death in the family , or facing eviction / moving due to house sake etc. Something dramatic but believeable in the circumstances .
This means you get out earlier than anticipated and have more time to get yourself together deciding your next career move
Hope things workout0
