Hello
Please can anyone advise me if there is any way a creditor can update your credit file after the default account has dropped off and is no longer visible without a CCJ or something else ?
We are nowhere near a CCJ but I am now making a complaint prior to Ombudsman referral as no one has come back with a CCA since August despite two requests.
Stepchange advised formal complaint prior to Ombudsman complaint to motivate them into action. Does anyone have experience of utilising the Ombudsman when debt agencies have not provided the credit agreement. Am hoping they contact us writing the debt off seeing as some of them offered us 90% off it a few years ago
The DCAs involved are
1st credit
lowell
cabot
This is part of a DMP which we are trying to negotiate a write off or F&F settlement and having checked all three credit agencies, these debts are longer visible on any credit files we can see
Stepchange were unable to provide a definitive answer
Many thanks

No, as there is nothing to update.
If they accept a debt as unenforceable, they will say as such, but they most likely wont write the debt off, despite knowing they have little prospect of repayment.
You use the Ombudsman only if they do not reply to your requests. If they periodically state that they're still looking and your accounts are on hold during this period, the Ombudsman will not tell them to do anything else. if they're ignoring you, then the Ombudsman can tell them to not ignore you.

Thankyou. I'm hoping this will motivate either a write off or small percentage settlement0

They can send account data to the CRAs as far as I know, but they will simply not show it. It will just vanish into nothing.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

The Ombudsman wont rule on issues of unenforcability0

I'm just hoping that they contact us and we can at least enter at least some sort of dialogue, because we're getting nowhere at the moment. Stepchange have advised us to maintain payments for now.0
