LONG I KNOW
i just need help not should have done !
really any points very much appreciated
I have a serious problem which I am about to post on MSE I would appreciate your view as a well balanced point of view, it is about my 19 year old son and is as follows .
My son was talked into buying a car from Evans holmshaw he was just eighteen at the time he stupidly signed up the hp agreement, the next day I told them as did he told them he was about t lose his job
And he could not afford the car. He was told as I was it was too late he had signed , but he can buy him self out for between 4 and 6 hundred pound which he didn’t have. He did not make one payment on the car although he kept up the insurance albeit late. After around seven months his car was stolen and written off. The insurance company wanted to cancel his insurance before the theft, he could not claim on his insurance as they demanded around 15 hundred to settle the claim. He was not working and obviously had no funds. He has now moved down south somewhere I think i avoid this debt the finance company are now Applying to the courts expect judgment. Is there any thing we can do to help him, I do not have contact with him and do not know where he is. I cannot help him financially as I do not have the means the figures at present are around 11 and a 1/2 thousand and are set to rise with court costs solicitors fees interest etc. I do not know and do not know where to turn for advise as he is over 18
please

Hi
Your post raises a number of arguable issues right from when the agreement was signed.
However it is your son who needs to make these arguments himself.
I presume the credit agreement was signed on trade premises and the garage arranged the finance and insurance and signed the credit agreement on behalf of the finance company.
Did your son collect the car from the garage and use it before it was stolen.
If your son can claim successfully from the insurance company would that be acceptable to the finance company and an end to the matter.
There may be a shortfall but the garage may have sold gap insurance (full replacement cost) as well.
Check to see who signed the credit agreement for the credit company as if the garage did NOT then there would have been a window in which to cancel.(only 24 / 48 hours before it was signed by the finance company (especially if credit check needed).
I or others can give a further response when you have read this.0 -
Hi,
Really sorry to hear about issue your son is in xxx
But i can relate to a similar situation with an old boyfriend. He bourght a car from a citron garage years and years ago brand new. For some reason he changed his mind after signing the documents but i cant remember what for.
He went in the next day and asked to cancel the agreement and was told he could cancel but there would be a fee to pay.
Cant remember how much tho but he did have to pay the fee to get out of the agreement.
good luck and hope you can get in touch with your son, but i'm affraid running away will only make the problem worse... xxxBank Charges refunded from Halifax £2600Bank Charges refunded from halifax joint account £554Credit Card Charges refunded £300 plus interestI'm proud to be dealing with debt!!! :T0
