Post bankruptcy issues....

Went bankrupt 22nd August 2006, discharged 1 june 2007.

I have 2 CCJ's from pre bankruptcy and lots of defaults on my record, also pre bankruptcy.

Problem is, my bankruptcy shows on record as being discharged, but the CCJ's are not marked as satisfied, also the defualt records are still being updated which keeps them current.

I think I may be in a grey area with the CCJ's as technically they are not satisfied, they are just not enforceable. But as I clearly wont be paying any of my pre bankruptcy debts they will always be there.

Does anyone know how I can get these marked as satisfied or removed, and also does anyone know if I can get the updates on pre bankruptcy debt accounts to stop?

It is really affecting my ability to get on with my life now, most places dont mind the banktruptcy so much, but they dont like to see current unsatisfied CCJ's or updated deliquent debt records.

As an aside, the only credit I have at the moment is my mobile phone contracts which I kept throughout bankruptcy and always kept them clean. Also my ban account is on record as clean too.

    Not sure about the CCJ's (will check at a more godly hour), but they drop off your CRF's 6 years after the judgment whatever happens.

    But, the bankruptcy (which would be more recent and will fall off the CRF 6 years from it's date) looks worse for credit scoring than the CCJ's (just). So it might be a bit academic getting their status updated. But as said I will check if no-one else here knows.

    Re the CCJ's.

    The reason I mention it is that my bank, Nationwide, told me that once my bankruptcy was discharged and I had my cert to prove it, they would upgrade my account so I could have a debit card, thats all I want BTW.

    They now wont do it because of my credit score, having been up front with them over everything and having been told it would be ok, I have no choice but to assume its down to the CCJ's or continuosly updating default accounts.

    Whilst I doubt there is any way to remove anything, after all there is no dispute that I owed the money, it would be nice to see all the loose ends tied up.

    That way I can go back to the Nationwide and give em some grief.

    Its annoying me because I have put a lot of money in that account since I opended it over a year ago, well in excess of £50k, it has always been well run and maintained a positive balance without ever missing a DD etc.

    I am starting to think they were misinformed, I am being polite, they wont do as they initially asked. I am, however, loathe to move the account as it does not improve matters if you move accounts a lot.

    Have you thought of a pre-paid debit card if that is all you want?

    Some charge a small fee per month ( a fiver) and others do not, but anyone can get one and they can be used almost anywhere:

    If you were to open another account, you could always try the co-op cashminder specifically for BR - this comes with a Visa Electron too.

    The co-op have been fantastic with me so far, and I have not even gone bankrupt yet (seriously considering it though)

    Had a look/think on the issues of the CCJ's.

    The official information that the 'Public Record' info on your CRF (judgments etc) originates from is maintained by the Registry Trust.

    For that info to be amended you need to apply to the court the CCJ was issued by for a 'certificate of satisfaction'. The form required to do this (N443), and all the official info I can find states that:
    You must provide evidence that the debt has been paid in full or state that the court already has this information.
    The court will not be able to process your application if it has no evidence that full payment has been made.
    That suggests to me that since the CCJ hasn't been "paid in full" that you won't have much luck. BUT, I would suggest that it would be very much worth your while asking the court that issued the CCJ to confirm/deny. That way you will know for sure. :)

    As I said before, the bankruptcy on your CRF has the biggest/overriding impact on your credit score.

    On the issue of Nationwide, from everything I read and hear they won't consider upgrading your card until the bankruptcy is completely off your CRF. :( But it would be nice if you could prove that wrong.

    Thanks for that Fermi, I shall contact the courts and let you know how I get on. If I dont get a clear response I shall just apply to have it marked as satisfied and see if the creditors respond at all, you never know your luck ;)

    I am unsure that the pre paid cards are going to do me any good. TGhe only reason I would want to do this is to start building an entry of good credit on my file, but as its prepaid I dont see how you can have a good entry of credit, a bit like having a pay as you go mobile registered on credit file.
