Holiday Pay Entitlement

Hello Can anyone please tell me if an employee that has worked for a company 7 hours a week for 1 year, is entitled to holiday pay? If the amount of work hours above does not meet the amount that is required for entitlement. Can anyone please tell me how many working hours a week someone has to work to qualify for holiday pay? Thanks

    Entitlement to paid holiday starts first day.

    Statutory minimum is 5.6 weeks.
  • Providing that the company pays prorata for bank holidays, the employee is entitled to a minimum of a week's pay per quarter.

    The minimum for a full time worker is 28 days, although most typically, employers incorporate bank holidays in to this, which they are entitled to do.

    The answer is: 7(hours) x 5.6.
    Or 39.2 hours = 39 hours and 12 minutes.

    EDIT: I was corrected .... but the correction provided also contained a typo :)

  • Let's be more precise. There is no minimum number of hours, but the employee is not actually entitled to holiday PAY - they are entitled to paid leave. And they must take their statutory paid leave during the leave year.

    So (at minimum) an employer cannot make it impossible for an employee to take statutory minimum leave during a leave year (although plenty try). However, if an employee deliberately fails to request any leave for a year, I don't think there is any entitlement to carry the whole amount of leave forward into the next year, or to be paid for it, is there? (Others may know better.) If you have simply not requested any leave for a year you may have difficulty getting paid for your 39.2 hours. If the employer has never told you about paid leave, that's a different matter. Most employees are legally entitled to a Written Statement of the main terms and conditions of employment within two calendar months of starting work. Have you been given this? Does it outline leave? Have you requested leave?

    No. If your are an employee or a worker that is the case. But there is an assumption here that you are either, which is not in evidence right now. You haven't given any evidence of anything. You asked a question assuming an entitlement that you may not have. Perhaps you could explain the background to why your are asking the question, and why here rather than with your employer?
