Private car park fine

I just got a ticket through the post for a parking fine from a private company. It was for being in a private car park for 3 hours and 43 minutes at 13:18 to 17:02

The thing is the first I have received about this ticket was today 22/11/17 but the date of the contravention was 12/07/17. Do they not have to send a notice within 15 days of the contravention? Or is it different with private companies and official fines?

    Highview Parking don’t attempt to invoke ‘keeper liability’ under the Protection of Freedoms Act 2012. The only way they can do this when using ANPR cameras to capture overstays is to send the keeper a ‘Notice to Keeper’ within 14 days of the day following the parking event.

    If they are not invoking Keeper Liability, they can only pursue the driver, whose identity they have no clue about - hence obtaining keeper details from the DVLA so they can ask the keeper to provide the driver's details - there is absolutely no obligation on the keeper to do so. HV can write to the keeper at any time if they are only seeking driver details (although the DVLA impose a 6 months limit for the PPC to access the keeper details).

    HV are easy to beat. The fastest we’ve seen that happen is 2 hours. See if you can beat it. You send them the blue text initial appeal template from the NEWBIES FAQ sticky, post #1 - don’t alter or add anything to it. You follow the appeal method that HV have indicated in their letter. If they are asking for your name and full postal address (as the keeper) give it to them - don’t try to be clever by providing an email address instead.

    You must be careful that you don’t give any information about the driver. Be careful of any drop-down boxes which declare your position, especially watch for defaulting back to ‘I am the driver’ if you go back and amend anything on their portal.

    adapt this template I posted in this thread and appeal as KEEPER (not driver)

    they have failed the 14 day POFA2012 rule of law

    so most of that template appeal can be used

    they are being cheeky like Parking Lie and trying it on

    Thanks for the reply Umkomaas! I just went to do exactly what you said and I got to the appeals website and it asks for a pcn number, on the letter there is no pcn number only a 'charge notice ref number' which doesn't work. Any ideas?

    the charge notice reference number IS the pcn reference number

    if you can appeal by email (or by post) then do so , adapting my template accordingly

    It gives two options and you have to choose one, is it ok to tick the second one and say I was not the driver or the PCN I received contains incorrect information?
