Turning down job offer whilst on JSA

My husband had to attend a group interview for KFC last week.
He received a text message today offering him a position of team leader with a fast track to management. There has been no mention of hours , salary or any job description.
Obviously the job would entail him spending long periods of time on his feet, which is a problem as he suffers from osteoarthritis of the spine and cannot spend long periods of time on his feet without ending up in pain and unable to move very well. The job centre are aware of his back problem.
I would like to know,if he turned down the job on health grounds, would he be sanctioned?

If he hasn't seen any of the t&c's for the job he's not yet in a position to either accept or decline the job. Once he has details of hours, and job description he will be better placed to make a decision. If he is to decline on health grounds I would suggest he will need supporting evidence from his GP.

Can the DWP override the statement from GP? It happens on ESA.
  • If what you say is true then he is on the wrong benefit. if you are on JSA you should be able to do whatever you get.

Just take the job and see how it goes. Team leader might not be that bad.
He can ask for reasonable adjustments. If it causes problems the doctor will have to sign him off afterwards.

SAying "I can't do this, I can't do that" before hand will make the Jobcentre staff think he is a refusenik. I imagine they hear a constant stream of excuses from everyone
Changing the world, one sarcastic comment at a time.

I didn't claim that the JC would be bound to accept a statement from the GP as proof that a person was unable to do the job, simply that it could provide supporting evidence of the reason for turning the job down.
The ESA assessment is all about determining what a person is capable of doing, and not being able to stand for long periods would show in the assessment.
If, for example, a seat could be provided that would remove the obstacle to working.
I have back and knee problems which make it painful to stand for extended periods. I can however walk for miles. My problem is that being still for extended periods causes my pain.

Why did your husband apply for this job in the circumstances? Are the Jobcentre aware of his difficulties?

He had no choice. It was arranged by the job centre and if he had refused to attend, he would have been sanctioned.
He did state in the interview, when asked why do you want to work for KFC,that he didn't that he was only there because he had to be.
It is in his file that about his back.

Thank you to all who have responded so far.

His back problem is not severe enough to be on ESA, he has been assessed for it before and not got anywhere and it varies from day to day, week to week.
The effects of standing for a long time aren't immediate, but would be enough in the following days, that he would be unable to go to work, as he struggles getting up out of bed and walking around, never mind spending several hours standing.

Another stumbling block (aside from the low wage, about £7.00 p.h. we think) are the hours. The branch local to us is open until midnight and the last bus home leaves the bus station at 00.03. My husband doesn't drive and we have two children at home, so if he worked the late shift,he would have to get a taxi home which would be expensive.
  • Does he have any of his own efforts/jobs he wants he could chase after and make happen instead?

If 25+ it is £7.50 per hour - this food chain aren't exempt from paying NMW.

This is a situation where I'd try saying I can only work x y x and await their reaction. Best to be the nightmare employee before you start! Wonder what would happen if no response was made to the text message. Whether the job offer cancels in so many days or hours.
