Leaving before notice perios

Just looking for some advice, i work for a home care company and will have been there 2 years in janurary. Theres is a breakdown in communication with my manager as in if i talk to her she just bites my head off, she rang me in my own time the other day shouting at me for gossiping about a carer i have never even met and never said these things about even though she would not listen, so i have had enough and found a new job which they want me to start a week tuesday. My contract states 2 weeks notice but i dont want to stay even a week let alone 2 . I just wanted to know if i leave earlier than my notice period, can they withold my wages for the hours i have already worked? Being so close to christmas i cant afford this? Thanks for any help goven

  • Would you need a reference if this is going from care role to care role? just thinking if it gets said you went AWOL? If reference hasn't already happened then this could well be said - Then this quick start job turns bad, then where are you left?

    An employer who doesn't give you time to serve notice may not be a good one. Have your interests in mind at all.

    I'm not judging you. Recently I was taken on to make other's life's easier (what they don't tell you at the sales pitch of an interview) and the actual insistence I start right away should have been the first of many worrying flag.

    In answer to your question - I believe they do have to pay for hours worked but seriously I would worry about the backlash, burning bridges and becoming the vulnerable new employee all over again - 2 years is a long time to just walk from current employer without talking this through.

    Please do not do anything in haste. There is a saying for this.
  • I seem to remember from years ago there was a thread on this forum where someone was being sued for the costs of a temporary member of staff as the poster had not given sufficient notice.

    How often that sort of thing happens though I have no idea.

    Do you think your line manager would discuss the issues you have or do you think the relationship has broken down too much?

    If you think the situation can be salvaged, bear in mind that the employment rights clock is reset. Also bear in mind, if it's the same industry bosses may know each other & possibly talk so it might be best - if you decide to leave - that it's best to do things by the book
  • Thanks for the reply, it is my decision to want to leave earlier as communication is not the best and its all very clicky as in if your face fits or your happy to be up your managers bum your fine. I am going to see if she will just let me go quicker and i also want to make it in time for the new employers payday for xmas.. i know she wouldnt sue me as there is alit i could report back on. I understabd the new place may not be as cracked up as tgey say but i would rather that than stay at my current place
  • Thanks for the reply... i dont believe they would sue me, she has made manu comments along the line as she will be gettin full time staff and soon as she hs had enough all us part timers will be loosing hours , slags the carers down to other carers in the office i just dont want to be a part of it anymore im so fed up of being spoken to like crap from my manager

    Do you have any annual leave - so last physical day of work be a week Monday but officially still employed till the end of your notice period

    Id second not burning bridges. Not only that but if you're going to a care job they will need references/ dbs which all take time. Thing is you might need to use these as a reference for a few years yet, and 2 years is a long time to cover
