Hi all
This post is on behalf of a friend of mine.
She has an NVQ Level 3 qualification in Care and has worked in Care for 20 odd years. 3 yrs with current employer.
She has found out a few weeks ago from a couple of colleagues that they have been given a pay rise, as they have an NVQ Level 3 qualification.
She has asked her manager why she hasn't been paid (and backdated) this. Manager told her to talk to head office. Head office have responded saying that only 'selected ones'' get the new rate of pay.
Obviously she is fuming about this. Her manager is going to look into it.
Can anything be done in the meantime? Is this legal?

Unless they are differentiating for discriminatory reasons (age, sex etc), it is lawful. She could ask what she needs to do in order to qualify for a rise.0

Yes, it's legal. A certain qualification doesn't automatically entitle someone to a higher rate of pay. These days, often pay rises aren't awarded automatically, you have to present a business case to the employer.0

In every company in the world this happens every day, all the time.
Of course it's legal. They can pay anyone what they want for whatever reason they want. They can not pay your friend as much as everyone else simply because they don't like her. They can do it because they think she's not worth as much. For all we are know she isn't worth as much and they would be fools to pay her the same as the others.0 -
Thanks for your comments.
I think it's just the fact that my friend works very hard, is bloody good at the job (and her manager knows it), and is never off sick, unlike some of her colleagues, who are getting this NVQ 3 rate.0 -

Why do people make a big deal about this? She works in care, if she's ill, she should be off in all likelyhood0 -

She should therefore look for another job where they will pay her the higher rate.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

I presume you work there as well, as otherwise you couldn't know if she is any good at her job, or what her manager knows. That being so, why do you think the company is going out of their way to damage themselves by paying more to inferior people?0
