Employed but company wants employees to be self employed?

Get him to sign up with some local agencies that deal with industrail work ie building sites / ware houses etc

Can you check his CV over for him? or find som e one who can, this may help as well

If this is the building trade (although that only seems to be speculation so far, perhaps the OP can clarify) then many people are effectively self employed under the Construction Industry Scheme. However, it works in a very different way to what is being suggested, so it is most likely this a a cheapskate employer trying to get out of their employment responsibilities.

Op, your friend can obviously do labouring work, so I would suggest he signs up with an Agency such as Coyles or Jark. They pay good rates for labourers.

Sometimes they even look to upskill their staff to cover other duties such as handyman! or vehicle marshall which pay even more.

So it probably depends on how long the job is going to last as to whether it's illegal or not - I suspect that while it's certainly a way to reduce cost to the builder and push it (and a risk) onto the individual, it's not illegal. Now that to me at least would make perfect sense...however it would appear any site you work on regardless for 1 day 1 week i month and so on,if your given duties to carry out then your under direction.

When im driving Forks..i pick and choose who i lift for..when i do the lift and how i carry that out,so as far as im concerned im not under direction,but the powers that be say i would be..lol

Strictly speaking every single person on site is under direction of the site agent...yet brickies/trowels/chippies dont fall under that....:(
