Yeh well she said to me she will leave a neg unless I refund her now (with no mention of her returning items). So I reckon you are right, and I will get a neg either way... but that's fine, as after a week, you won't be able to see her neg anymore as it will be pages back...
But whatever happens with this (involving disputes etc), it has to be done quick, as I'm going to Africa in 19 days, and won't be back for 3 weeks, and don't want to come back to loads of trouble! :eek:I:coffee:

Its like Seconds Ahead - they've sold Next clothes, albeit with the tags cut out. They also sell other brands.~*Cerenia*~

Hi Charlotte
I actually work for next, and have worked for 2 other ladies high st retailers. This removal of tags is commonplace. Have you thought about trying to find which catalogue they were in and sending her a picture from this?
Buyer seems to be trying to pull a fast one IMO. Ebay & Paypal are a law unto themselves, so I don't know what the upshot would be if she tried to claim item not as described, but I'm all for telling her to get knotted! She has bought the item and is stuck with it. I'd be inclined to send her this thread (Don't!) and show her that she is talking rubbish. Unfortunately the sort of rubbish Ebay are likely to take heedance to...0 -

So i don't see why I should let her get away with this, and I will still be a little out of pocket for the postage i paid, when I've not actually done anything wrong. As im stubborn and refuse to refund/let her return items... So you think I should just let her leave me the neg??
I only have 2 negs out of 600 feedback, and they were for problems that wernt my fault, so I'd hate to get another! Arghh I hate some ebayers
As someone who buys clothes from a wholesaler and then resells them (making you a trader) you have to offer refunds under the distance selling regs.
If you don't show your returns policy on your auctions, your buyers have 3 months to get a refund, and only have to make the item available for collection rather than returning it.
So in reality your buyer can insist on a refund and does not have to return your item.0 -

Lots of companys cut off the tags, as they dont like their stuff to be resold with tags on. So that is why they had been removed.. wherever that was NEXT or the wholesaler that did it.. i don't know. but that is what all my hwolesale items are like
I believe it's because they can't then be taken in store and refunded or exchanged when they have been bought at a cheaper price.Lost lbs =

Yeh I guess i will have to make a note, but there isnt mch I can say against it...
I assume she will just say something along the lines of:
"Fake Item, no refund, avoid this seller!"
so i could say something like:
"The item is not fake. Ebayer just wanted her money back, and wouldnt belive the truth"
no thats useless.. lol, what can i say in reply????
I'd make a note saying the buyer is obviously wanting something for nothing as if she wasn't happy with the item then she wouldn't want to keep the item and have a refund.
Tell her to take it up with paypal as you can prove that it is all above board anyway! If she leaves you a negative then you could always try square trade and see if they can remove it for you.
Also if she says you are selling fakes on your ebay profile then you always have the law on your side with regard to defamation of character/libel if you can prove it's not true.
Have you already left her positive feedback?Lost lbs =

Thanks for your response
No luckily i havn't left her any feedback yet. I tend not to leave the buyer feedback first, UNLESS the buyer has alot of feedback, or has no bad negs etc.... As i've learnt from that mistake in the past!
Oh btw... this woman has 59 feedback, and one neg... so shes quite a newbie... and isn't exactly perfect!I:coffee:

Good good, i never leave feedback til i have received it and know they are happy with everything and there's nothing for me to resolve.
At least you can always neg her back if it comes to it, i'd make her aware of that too because she's been a less than perfect buyer. She may start being a bit more reasonable if she realises that she doesn't hold all the cards. xLost lbs =

She won these on the 5th October, and paid immediately, I posted them soon after. she has now receieved them, but wants to keep them, but get a refund as she THINKS they are fake. but the thing is... she doesnt deserve a refund!!!! I sold her a good item for a bargain price, and all my other buyers loved them
She's entitled to a refund, and doesn't need a reason. You're a business, therefore you have to follow the DSR. Sucks, I know.0 -
hi
sorry I am with the other couple of people - you are not a stay at home Mum, you buy to sell, this classes you as a business, so under DSR you HAVE to offer a refund upon receipt of the item, within the speicifed timescale.
I would offer this quick so that she goes away happy, as some people try to make trouble for others, (we are a VAT Ltd company), and we still had an unhappy customer threatening to report us to INland revenue for trading (to which my reply was go ahead and gave them my co no and Vat no)
If you are not registered with them as either self employed or company then this could cause you big trouble,
finally....sorry I sound all doom and gloom, I hope you said ex chainstore not Next in the title as some rights holders are vero'ing ebayers for using their registered trademark - next and river island are very hot on this, I had some pulled for calling mothercare tights...well mothercare tights,...even if they are defaced you do not have the right to use their name (which I think stinks)0
