Hi,
Were looking at claiming our late payment charges back on our mortgage.
My question is....
1. Am I able to?
2. With the current OFT announcement will they put the case on hold?
Our mortgage is with Birmingham Midshires which I think it part of Halifax bank.
Thanks in advance.

No. They are not a penalty but a charge for a service.0

Hi KTF,

Its a late payment charge which would indicate its a penalty?
Could you clarify if your able to? I think it might just be me being thick:o
Thanks in advance.

Its not a penalty charge. its an admin charge to pay for the work involved. Admin charges do not have the same restrictions that penalty charges do.I am an Independent Financial Adviser (IFA).
