S*** HAS HIT THE FAN !!!!
re my last post (thurs) concerning telling my OH the extent of my debt problems, well my hand was forced today!! this is a long story
Today We received in the post a court date for a suspended possesion order (had been expecting it and was trying to intercept!!) for a secured loan which I have fallen into four payments worth of arrears, , I have spoken to the solicitors dealing with it and they assure me that provided I stick to the repayment agreement made to cover the arrears and my monthly installment the order will not be enforced. OH spotted the letter addressed to him (joint loan) and I had to come clean, was avoiding going home to face music and ended up in hystirical tears, so much so that he thought I was going to tell him I was having an affair!! OH was great about it, he knows the extent of my debt (not the full amount but as near to dammit) and was more supportive then I thought he would be considering I have been lying to him.
Feel so ashamed and dont deserve any sympathy as I got myself in this mess, and I feel terrible for misleading my OH.
What I would like help with if anyone can, is information regarding Suspended possesion orders, as I have no spare cash to see a solicitor, and need some points clarified ie if by some miracle we manage to clear the full amount of arrears before court date (set for November) would that stop further court action and prevent suspended possesion order. Also if I manage to pay off arrears over a short period of time ie three months would the order be lifted after three months.
Any help gratefully received as am at desperation stage, so stressed and dont know how much more I can take of this, am trying to be strong for sake of my little girl but am at wits end.
Any suggestions/info gratefully received.

I'm sorry that you're feeling so sad and stressed about this, but fret not, you've done the right thing posting here and someone clever will surely be along soon with soe help & advice

i'm afraid I don't know anything about secured loans (apart from what a ball & chain they can be, we have one too
) or the suspended possession orders, but I'm someone will be able to help you.

Thanks Scarlett , feel very low and desperate at the moment, reading the boards I feel great sympathy for everyone in the horrible situation of debt and its nice to know people care.
Will try to dig myself out of the deep hole of depression and come out fighting again, just need some time to gather info before making any rash decisions.0 -

I'm afraid I can't offer any help as I don't know the in's and out's of your particular case but I can offer support insomuch as I went thru the same thing 1.5 years ago with my DH-I had to tell him about my rather large amount of debt that he didn't know about. At the time, it was the worst thing in the world but we are getting thru it. Don't get me wrong, we still have rough times but in the whole, things are better.

Thanks for your kind offer, I will take you up on that offer, but not today as I feel completely shattered by it all and cant trust myself with my emotions at the mo, but once again thanks for your very kind offer.

Oh my love, I do know how you feel I really do. I've been where you are now (very recently) and it's horrible, it really is. I only joined here on Tuesday, so I'm a LONG way from sorted, beleive me, but the support, kindness and fantastic advice I received over-whelmed me and really did help to bring me 'up', if you know what I mean?
Even though you and I are at the start our of journies, we will get there, i promise. Hey, when you're at rock bottom the only way is up right?
If you have a minute read my thread (think it's on page 3 or 4 now) entitled "It's all such a mess......." and see how the lovely, wonderful people on here helped me. And they'll do the same for you, I promise.

a suspended possession order is just what it says, basically the court have/will grant that the company take possession but this has been suspended and will not be acted upon inless you break the agreement that you made ie to clear the arrears. if you do manage to clear the arrears etc before the court date then this will go in favour for you.
You dont need to go see a solicitor about this, the CAB will clarify everything for you and adivse you on what the procedures are. If you go to court, remember to take with you any receipts or proof that you've made payments ( when i went with OH i forgot to take them, the other parties solicitor didn't have them from the company and luckily the judge took our word for it!!)
If or wjhen you go court, dont worry, its not a massive court room like you see on the telly, its normally the district judges that deal with these and its normally in a small office and whatever you agree to do the important thing is to STICK TO IT cuz the minute that you dont is the minute they can enforce the order

Thanks for the info, one question as the possesion order is addressed to both of us, do we both have to attend the hearing or can I go alone?

I dont know for definate to be honest with you but io would say that because its addressed to both of you then both of you should go. If anything then its support for you on the day.

No need for both of you to go if your husband can not get the time off work however it looks better as the judge can question both of you as to the reason for the issues etc.
You do not need to take a solicitor and there may be a duty advocate at the court on the day if so,you can use them. IF you telephone the court they will tell you if someone wil be there
.
Alternatively contact Shelter who may be able to go to court with you, you may be eligible for legal aid,
If you can show the court that you can clear the arrears within a short time they can make a possession order and suspend it, you will then need to apply to the court for the possession order to be lifted when the arrears are cleared.
however if you can definately pay the arrears within three months you can ask for an adjournment to allow you to do this. will need to evidence how you intend to do this and maintain on going payments at the same time.this is better because then no possession order will be made
