Hours reduced to zero

Hi all.
Hoping for a little advice, I've been working term time for a taxi firm as a driver since the stat of the year and as of Monday received an email to say my route is no longer available as it has been allocated to someone else due to restructuring, so I've gone from 31 hours a week to 0 hours.

After speaking to the boss it seems that as i asked for a tracker to be put in the vehicle as promised, my route was 5 hours a week more than i was paid he has employed someone prepared to work less hours doing the same route, now he has paid me "out of the goodness of his heart" PILON of on week but the email states an additional weeks pay in lieu but refuses to accept the additional week, staff handbook states 1 months notice.
So is the PILON correct or not, before i contact head office and my union, also as i have a disability finding new work will become a struggle.

Thank you for any help.

Employed by them? Or a zero hours worker? Or self- employer (which a lot of taxi drivers are). Whose staff handbook? What does it say?
  • HI.
I was employed with a contract ongoing until Aug 2018, it was in the company staff handbook which i was supplied when I started working for them, I was paid monthly in arrears and the staff handbook states on months notice in lieu of pay will be paid.
Basically I asked for my hours to be tracked and was offered no hours standby/relief instead.

  • Sorry also meant to say contract states minimum of 12.5 hours per week.

It's conceivable that you are owed the month then - if that's what it says, that's what is due. But also may only be at the minimum hours on the contract. If you are in the union you should talk to them. It doesn't seem that the dismissal is unfair in law - without two years employment there are only limited reasons you could claim.
  • Thank you.
Having tried to discuss this with my ex manager he has said I will only get paid 1 week and I'm lucky to get paid that as I'm not working the last week of employment?? due to me being on zero hours. laughable I know.
