Ombudsman can't help - what next?

I have formally complained to a company (UKsoccershop) following no adequate response through telephone contact or emails. I have not received a response to my written complaint - which was sent 'signed for'.
I contacted the Consumer Ombudsman and am shocked to find that they are only able to deal with complaints about companies who 'participate in the Consumer Ombudsman Scheme' I've been advised to either contact citizen's advice or take legal action. Legal action, I believe will cost me money.
Can anyone advise on what my next steps should be please? I have paid £115 for items that were not as requested.

    When did the goods arrive? (How long ago?)
  • Hi, I paid through PayPal, who won't action any refund. Told me to take it up with the company. I paid 31st May 2017 and received 7th June 2017. I immediately rang the company but ended up tweeting and emailing as don't answer their phone.

    Paypal have a 180 day (from purchase) period where you can open a case for an item "significantly not as described". Did you do that?

    Whilst it doesn't need to be detailed, it may help if you give a bit more information. What did you buy and how was it different.

    Did you fund the payment through Paypal with funds in your Paypal account or via a card/bank account (if so which).
  • I have evidence of my order for 2 football shirts with names and numbers on the back. I received the shirts with the end of the names missing and no numbers. The company are blaming Paypal. I opened a dispute with Paypal, who said I needed to complain to the company. I have a confirmation of order from the company which has the correct details ordered. I also emailed as soon as I received confirmation to be clear about the names to be printed as they're foreign.

    The Paypal payment went from my bank account.

    Ah, Paypal do not cover custom items for SNAD. Hence why you needed to give further information.

    As your funds went from your bank account, do you mean by you sending them there, via a debit card or some other way.

    I'm guessing the OP paid via paypal which then took the money from the bank account eg just like when you use ebay.

    We can't guess.

    There can be various ways you can pay via Paypal. If it was via debit/credit card they may have some avenue to persue. If it was by direct debit/credit into their Paypal account first then not so.

    Well we can guess but let's not go into that.

    Granted yes you can pay with funds that are already in the PayPal account or choose to pay via a card that's linked to the PayPal account.
  • Legal action (small claims court) WILL cost you money, but (I believe) you can claim it back from the other party if you win.
