Unauthorised use of CCTV accident footage - DPA breach?

Hi

A couple of months ago I was involved in an accident at work.

This was recorded on the companies CCTV.

Another member of staff has had access to the CCTV and has created a mockery video of the incident and this has been redistributed and has gone semi viral.

As they had neither my permission to publish the footage nor the permission of our employer can anybody advise if this is a breach of the 1998 DPA?

    I can't answer the question about a breach of the DPA, but surely it should be a disciplinary offence to have unauthorised use of the imagery anyway.

    That, but frankly I'd get over myself. If you don't, then your colleagues will probably take the next opportunity to mock you.

    Mocking which makes someone feel uncomfortable is bullying, and not acceptable.

    I wouldn't make any judgment without knowing what the video showed and how identifying it was (and bcfc you don't need to tell us, or provide links). If it was a simple trip and they can't be identified then I might let it go, but if it was something degrading or humiliating then they should be complaining to their employer.

    Why would someone do this to a colleague, if not to cause harm?

    I don't think you have a DPA case.
    Start an internal complaint against the colleague

    Tell that to the millions (if not billions) of viewers of "you've been framed" - this sort of 'unacceptable bullying' has been going on since 1990 at least.....
