Salary Sacrifice Car Payments from ex employer 2 years ago

Hi, first of all I hope that I have posted this on the right board, but I really need some advice here.
In march 2015 I took delivery of a new car that I purchased through a salary sacrifice scheme via my employer. Unfortunately, I was dismissed in may 2015 and obviously the car was handed back. Because of the short period of time I had the car it was agreed that there were early repayment fees to the car company totalling around £2000. I set up a monthly payment plan which I have been paying ever since.
In the last few days I have been sent a further letter saying that I now owe a further £800+ due to them not taking a full month's money in June 2015 and they are saying that the original invoice did not include vat?!? Although from what I can see it did?
My main question really is can they come back for more money after all this time? Also I am worried that they will further decide to change the goalposts again in time. I do not have the money to be able to pay this off in a lump sum, but they are pressuring me to increase my payments which I can't really afford. Any advice would be really appreciated.

  • Just to be clear the letter I have just received is from my ex employer not the car company. The agreement with my ex employer is to pay them back what they have paid on my behalf to the lease car company.

    Hi Loulou24 and welcome to MSE,


    I would suggest you write back and ask for a breakdown of what you have paid and confirmation (receipts/ invoices) of their out of pocket expenses at the time. If you have the original paperwork stating that the £2000 included VAT then you can also raise that and state you will not being paying the VAT now. You can make it clear that you are unhappy in the way they are handling this when you have always tried to be reasonable and make payments.

    Ultimately it is a non priority debt, and if you cannot resolve this issue between you, they would need to sue you in the county court. You can then raise these issues in court, but unfortunately, that can incur more costs with things like legal advice.


    Try asking for more information first and make sure you send everything recorded delivery and keep a copy.

    I have contacted the car company directly today to see if I can get a copy of all invoices that were sent to my ex employer that were paid on my behalf. Unfortunately because they are from 2015 they are taking a bit of tracking down in their computer system. I have requested them and will see what their response is.
    Presumably if the paperwork is not available through the car company does my ex employer have to provide evidence of what they have paid on my behalf e.g. Copies of invoices or is their word good enough? I only ask because so far I have only seen one invoice for the original amount of £2000 and the rest of the paperwork are calculations that have been worked out by the finance dept on an excel spreadsheet.

    Maybe there once was a time when a mans word was his bond ............nowadays though courts only deal with evidence, not hearsay.

    They will need to back up all there claims with evidence otherwise they have no case..
