Advice please

I currently pay the CSA for 2 children under the old CS1 system.
My son reaches 19 in May 2008.
Will my case then be reassessed under CS1 rules to take account of my son leaving the system or will it be treated as a new case due to the basic change of me having to pay for 1 child instead of 2?

    Yuor case will remain on the same system but will be reassessed to take account of the change . I would call them on your sons birthday to get it actioned asap.

    If you want to PM me I will give you an indication of the new amount - it won't necessarily go down you know! It almost certainly won't halve but I can certainly manage your expectations if you want.

    Thanks kelloggs. I certainly will PM you nearer the time. The overtime at work is fluctuating at the moment so I can't give an accurate wage at the moment. I'll give you an exact figure when I receive April & May's wage slips which arrive on the 15th of each month.
    I had anticipated the amount not reducing by much if I remained on CS1 because being 16, my Daughter doesn't usually stay over more than once a week & I gather that's not enough to qualify for shared care, whereas I'd receive 1/7 allowance on CS2.
    I think I'll live in ignorant bliss until May when reality will kick in!

  • I presume he is styaing on in education, as very few children stay on at college until they are 19, and don't accept the old chestnut of checking child benefit.
    Section 55 of the CS act defines what is a child and child benefit is not mentioned.
    Full time education of 12 supervised study, of a non advanced course, up to the terminal date after they finish attending (normally first Monday in September, but also January and Easter) but if they are 18+ and leave college then it can end straight away.

  • My Son's done his 2 year A level course in school. Then in September he has gone on to a local college of further education for a 2 year public service course. I've checked on the college & HMRC websites & his Mother is still entitled to child benefit until he is 19 (May 2008) as it is not classed as an advanced education course. I've always assumed that this meant I'd be paying until he is 19.

  • kelloggs, given the circumstances in the OP, is there any way a NRP can request a move onto CR2, particularly, as I understand it, all the old cases will be moved over in future to accomodate the forthcoming changes to the CSA?
    As you've previously stated, there's a chance my payments may not necessarily go down on CS1, but they would on CS2 because my Daughter stays over once a week on average.

    Unfortunately not Donedoingdebt. The only time that a case will be moved is if the PWC requests complete closure of the case and then makes a new application after a break of 13 weeks OR if either the NRP or the PWC are involved in another new application from another ex. In your case it is only a change in circumstances which does not instigate a switch over I'm afraid. I'm not sure what will happen to old cases when the new one comes into force but don't expect the logical to happen!!!
