CCJ - Unsure how to proceed

Hi All,

I’ve had Debt and mental health issues for the last few years, and have completely buried my head in the sand. But now I’m unable to ignore it any longer and need to do something to sort this out.

I received a CCJ a couple of months back which I ignored. I then received a request for a statement of earnings, which when a mention of prison was written down I responded the next day by 1st class post. I have now received a notice of proceedings as they did not receive the letter I sent. I’m in a complete state, it says that they will call a bailiff. What should I do? I’m at a complete loss and I feel like life just isn’t worth it with all this. I also have another £10k of debt on top of this.

    There is a procedure you can follow to sort this out.

    You need to give National Debtline a call in the morning, explain the circumstances to them, they will be able to help you sort this out.

    While your at it, get advice on your other debts as well.

    Agreed. There may be an overall strategy to sort all this out. I'm thinking Debt Relief Order if your total debts are under 20k, you have little surplus income and you are not a homeowner.

    I know a letter like that can sound alarming but don't panic. It sounds like the company who applied for the CCJ has either applied for an order to obtain information or an attachment of earnings order (to take money from your wage). That means they'll want you to provide further information about your financial circumstances, and there may be a hearing which you would have to attend.


    It's likely the bailiff has been instructed to hand deliver the paperwork again to be certain you've received it. Although you can be sent to prison for not providing the information, that won't happen unless you refuse to provide it.


    It's certainly a good idea to seek some specialist telephone advice on your options next. I'd also recommend seeking some support with your mental health if you've not done that already. Your GP will be able to help you, and you may want to contact a mental health charity like Mind or Rethink.
