House Offer....rejected...

Hi, started looking for a new home 4-5 weeks back and have seen one that we both like just down the road. called and put in an offer some 15k less than asking. my house went on the market about 3 days ago.
called the EA for an update but she said the offer had been declined- too low, so i advised i could revise the offer. she turned round today and told me i cant put in an offer until ive found a buyer for my house and the seller has found a house and offer accepted for something they like. incidently im using the same EA to sell my house and buy the next!!!

so i called another branch with a bogus name and said my house was with another EA. she happily accepted my offer subject to me selling my current home!!,

where do i stand, as it seems my EA is holding me back. we both like the house and are willing to raise the stakes but it seems like we cannot proceed, is this how it works?..any advice thanks

  • The EA is required to pass on all offers, in writing, to the vendor - they cannot start adding conditions such as you must have found a buyer for your house. Go back to the EA and insist that they pass on your offer to the vendor.

  • For my last tree purchases I like you have found a property I wanted to buy put in offers which were excepted, then put my house on the market sold in first few days and went on to purchase the houses I wanted.

    However I have done this this time and have not been able to sell my house. Although EA have to put forward offers I think it is pretty useless unless your in a position to proceed.

    I have now stopped looking at houses because the market is dead. And looking at the this website a lot of people are pulling out of purchases as they are hoping the market will crash.

    If I were you I wouldnt do anything until you sell your own house...fingers crossed it wont be long.

    EA does legaly have to put forward offer but he can also say to vendor that you are not in a position to proceed then the vendor gives them the instruction to refuse offer ubtil you can proceed.
    I like to give people as many choices as possible to do what I want them to. (Milton H Erickson I think)
