Hi All,
I had a letter from Lucas Credit Services about a month ago and its for a debt that was back in 2011, a phone debt, now I sent them a letter asking for proof of signed agreement etc, they sent one back saying its a service agreement not a credit agreement but with statements etc the statements make no sense and they want me to reply within 10 days otherwise it will go to another company to collect the debt such as bailiffs I bet.. here is the funny part at least or me!
The debt is now over 6 years old and its not on my credit report.. I've checked Noodle, Credit Score, Experian and Equifax but looking at those reports the debt is not on any of those credit reports it was though on my noodle credit report but has now vanished.
Shall I send a Statute barred letter with a copy of all 4 credit reports?
Thank you in advanced.

If you haven't paid anything towards the debt, or acknowledged the debt in writing, for a minimum of six full years then the debt is statute barred and you can send the letter. You don't need to send anything else.
Be aware that it's not unknown for mysterious £1 payments to magically appear on the debt so be warned."There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. We shall never see their like again". O S Nock0 -
Hi Oddmaker
If there’s no CCJ for this debt bailiffs cannot be used, so don’t worry about that. If the debt does not show on any of your credit files it’s either because the phone company never contacted them to record it, or the default on the debt is over 6 years old and has fallen off.
As poppasmurf_bewdley points out, if the debt is statute barred there’s no need to send copies of your credit reports (that doesn’t actually prove anything). Just send the statute barred sample letter and leave it to the debt collection agency (DCA) to see if they can prove the debt is not statute barred. If they can’t they’ll have to stop pursing you. Good luck with it.

Wont be bailiffs, just good old fashioned debt collectors, there is a big difference between the two.
To engage a bailiff, first a creditor must of obtained a county court judgement against you, and then you must of failed to keep up with repayments, only then can a bailiff be engaged.
Debt purchasers regularly use other debt collectors to chase up their accounts for them, in your case i would simply send the statute barred letter and see how they respond.

Thank you for your information, I will send that letter and see what happens.
I don't think I have contacted them about the debt but it was 6 years ago so you never know, I will find out once they reply.
Thanks again0
