CCCS would have included the DLA element as income and allowed incurred expenses to be off set by the Benefit payment. Otherwise your budget may show taxi fares, special expenditure and purchases that could not be substantiated by the income. This would indicate a deficit budget. So it goes in but is off-set. DLA is not there to pay debts, unless of course you don't spend it on anything else, which is completely unlikely.0

The SOA you fill out with the CCCS isn't set in stone, you can always phone them back and alter anything you want, all it basically is a form for you and the CCCS so you and they can make some financial decisions based on it.BR 4/10/07

Had another interview with the CCCS today and mentioned about the DLA being included. There had not been anything put down for my disability to cancel out my DLA, so my SOA was completed again by another lovely gentleman.
Now, instead of £228 per month, we have £90 to pay in a DMP - big difference and has made me feel better as it is much more realistic for us to pay.
Fair enough it will take me years and years to pay off the debts, but if I can make a start and attempt to pay back it makes me feel better. If I have to go BR at the end of the day, then so be it, but I would like to think at least I made an effort!
We were seriously going to go bankrupt this week, as I could not see me being able to afford £228 per month long term at all. It was said that many in my situation (no assets and on benefits) would have no hesitation of going BR but I don't feel right about doing that.
Now, we have decided to go on the DMP instead - this way we are paying back which is what we wanted to do
Waiting for the harassing phone-calls, letters etc now - I believe it starts to calm down after three months. We shall see.
As for any creditors not agreeing to it, then IMHO they would be shooting themselves in the foot given I have no assets, because the only alternative would be BRtcy, then they would get nothing.0 -
Glad to hear you got the issue with DLA sorted out. You now, as you say, have a much more realistic amount for DMP. I hope the plan works out for you and that the creditors agree, - of course they should as you say, because otherwise in BR they might well get nothing but these organisations sometimes dont seem to be able to think logically and insist on running an "all or nothing" attitude to their own detriment.
Let us know how you get on, and if the phone calls dont stop or start again after a few months when some of the creditors chance their arm at getting a bit more out of you (they have no moral scruples in my opinon and experience) get some help from the clever people here (not including myself in that LOL)0 -
Thankyou Gratton, when I send my letter into my creditors I will mention that if they are unable to agree to the DMP then I will have no choice but to go bankrupt and as I have no assets that means they will get nothing.
I am ignoring phone at moment and awaiting new paperwork from CCCS.
