Hi All again,
update, one of the two creditors who were refusing my offers has now accepted leaving one; the MBNA, who have stated that they will not and they are passing it to a debt collection agency. After Rosie's really helpful breakdown of whet they can and can not do I felt better but I have had a bad day and got my latest statement from MBNA which states and I quote " To avoid legal action OR collection agents visiting you, call..." etc.
I am making the payments I have offered even though they have been refused and I was expecting for agents not to just drop round but to send letters to try and settle and then if they didn't accept for them to get CCJ and only then if I defaulted they could send people round!
Can they just send someone round before I have even had a letter from the debt collection people or been issued a CCJ etc or are they just trying to scare me.
CAB have officially closed my case and are now leaving me to deal with debt collection on my own!
Feeling very anxious again and living in fear of any knock at the door!0 -

This is a threat with very little basis.
Under OFT Guidelines, they can only come be previously arranged appointment (agreed with you) and if you do not want them to come, they cannot.
IF they did turn up contrary to the rules, they have no right to speak to you or come in your house. Even if you answered the door by accident, you can tell them to go away and write to you. if they refused, you can call the police and they will remove them, although it is extremely unlikely they would stay long enough for that to happen.
So please stop worrying, you need you energy to sort the rest of things out.

But I have just done the CCCS on-line thing and they state my best rememdy is bankruptcy!!! - there is no way I am doing is as I will lose the house and I will not do this for the sake of my kids.
How can they recommend this! When I have 4 out of the 5 creditors on-board with the DMP and just need help with the MBNA to do the same as I do not feel up to the task myself since CAB have closed my case.
Please tell me this is only because it is an automated system and if I phone them I will get a different response!0 -

aww hugs for you...all souds v. stressful for you. Do ring CCCS - they may recc bankrupcy but at least in talking to someone you can discuus pro's cons and go over things with a real person. Do you have any equity n your house? If so would it be worth selling and renting somewhere for a while? yes it would be hard but if you are unable to meet payments better possibly to take control of the situation rather than have it taken out of your hands. I do think you need some support with this - practically & emotionally. That way you ca sort and move forward rather than living in fear as you are at the moment. just a note on the pm instructions, it is case sensitive DragonLady will not get you to dragonlady.
Regarding BK, it is not the end of the world you know but if you have equity, then there are issues (if your mortgage and secure debt place you in negative equity, you might keep the house).
Who ever you speak to, providing it is a charity not a money grubbing company, will tell you what they advise but let you make the decision.
The calculations will be based on your current income and the size of your debt. There are suggestions that anyone who would not clear their debt in 6 years might as well go BK, but there are people here who do not want to do that and will be paying the small sums that they can afford off until they die.
What the system cannot do is work out that you intend to try and increase your salary when x happens or that you have a divorce settlement coming you way. So you may be advised that you could go BK, but you will not be pushed to do that.
And without knowing your income and monthly expenditure, we can't really advise you.
