occ ashtma claim

was diagnosed with occ ashtma taken off my job and put on another job which is over £2.00 an hr less, put a claim In and the solicitor said I need another opinion for the court the 2nd consultant said I didnt have occ ashtma and now I cant claim loss of earnings and was told only the 2nd consultants opinion will be relied on in court does this seem fair
