Hi Everyone,

I've read the newbies post regarding the parking tickets and just wanted to post this situation to see if you can help.

The car was parked in the Hotel carpark which is next to the place of work. It has reserved parking spaces marked for the company but apparently the Hotel no longer supports this. The car was parked there on the third and fifth day from start of the job, at the time a ticket was not purchase due to the "reserved company parking spaces" - PCN(s) were received through the post some days later.

When we received the first one, I googled what was the best course of action and came across the post on this forum. I decided to appeal as per the BPA post. Afterwards we received the second PCN, which I have not appealed or done anything with yet.

The first appeal has been rejected, so I guess my question is:-

Due to the fact that a ticket was not purchased because of the reserved parking, and that the appeal has failed - what is the best course of action now?

    All the next steps are set out in the newbies FAQ thread

    The keeper should deal with each ticket separately.

    You are advised throughout here to never reveal who was driving

    Thanks, we haven't mentioned who was driving for the first appeal and the only reason I haven't appealed against the second one is in case they look at the two separate incidences as one. If that is something that they might do?

    I have read that people have ignored, and also checked via the search from the newbies thread regarding to how many cases this year have actually gone to court from all these PCN's - currently one.

    And if this is ParkingEye you need to send the same appeal to each one, not saying who parked, and if you drop the ball one one, they will sue you over it. Do not ignore one.

    POPLA, as explained in the NEWBIES thread third post, there are templates there to put together.

    Are either of the PCNs a ''golden ticket'' (our phrase) as shown in the NEWBIES section all about POPLA?

    As advised the keeper should appeal each one separately.

    The ppcs monitor this forum and can use your posts against you.

    That is why you are advised never to reveal who was driving here!
  • Thanks, They both have the POFA 2012 section on the back which, if I understand it correctly, is not a golden ticket?

    Nope, but you can use the other templates to make it a long appeal, and take some photos of the bays that were misleading, and embed those photos into the 'unclear signs' section of your POPLA appeal to illustrate it within the word document, so it reads like a long appeal, but painting a compelling and illustrated picture of a very unclear set up.

    The keeper can win this one on unclear signs and lines.

    Dear Sirs

    Re: PCN No. ....................

    I challenge this 'PCN' as keeper of the car.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.

    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    That blue type appeal is the initial appeal to the ppc (assuming you are dealing with a BPA company)

    Yes, that is correct, it is a BPA company.
