Title Deeds

Hi all

Myself and my partner bought our first property two years ago and we have just successfully remortgaged. We recently received a letter from the firm dealing with the remortgage detailing that our new lender (Bank of Ireland) do not hold title deeds and therefore they had requested that our old lender (Nationwide) forward on the tile deeds to ourselves.

I have just phoned Nationwide to confirm that they are forwarding on the title deeds to us now the remortgage has gone through, however they have told me they don't hold a copy of them. We weren't given a copy when the flat was purchased 2 years ago so I am a little confused.

Should we or the bank have received the original copy when the flat was purchased?

    When registration started, the first person to own the property after that may have kept the deeds pack and not passed them on to the next purchaser as they are no longer required with the property being transferred on the Land Reg forms instead.

  • Thank you for your reply. Prior to us buying the property there was only one other owner so I could contact them to ask if they received a copy when the flat was originally purchased. Is it important for me to get the original copy of the title deeds? If I cant get these should I request a copy from the land registry?

    If the property was registered when new, there are no title deeds.

    Only older property had title deeds and as each property has changed hands, it has been registered and the title deeds have stopped being the documents which confirmed ownership.

    There may previously have been deeds, but they would have gone to the person who registered the property and may not have been passed on since...

    The Land Registry does not have/keep them once the land is registered.

    What people loosely refer to as "the title deeds" these days comprise just a print-out of what's on the land registry's computer. Which you can get any time you like (or just view on their website), but the bit of paper isn't worth anything, it's just confirmation of what was registered at a particular time.
