CCA Requests

Hi
I have several debts over 6 years old which have been serviced with a DMP from StepChange.
I sent the credit agreement letters off at the beginning of August and this is the response I got
1 x letter from Next sending me an old photocopy of a blank CCA agreement with no details on, account opened in around 2004 with a balance of £200 approx owing saying this is a true copy or some rubbish like that
1 x letter from Lowell regarding a Lloyds debt saying they have requested the agreement from Lloyds and it should arrive within 40 days, still no follow up letter, and no agreement. Debt over 6 years old no longer on credit file and default date was ages ago.
2 x Letter sent to 1st credit for debts over 6 years old and no longer on credit file (defaulted years ago). No response from them.
1 x Letter sent to Cabot for debt over 6 years old and no longer on credit file (defaulted years ago). No response from them.
I only sent through royal mail first class delivery, didnt do signed service, have I wasted my time. Should I send the letter again ? We have been servicing these debts through a DMP for over 6 years. Or should I send a different letter ? Looked on the National Debtline website and got confused.
Many thanks

You have followed the correct procedure, the debts that have not responded, are currently unenforceable until you do get a response.
It can take some time as they must go back to the original creditor for the information.
Send a reminder letter if nothing after a month or so.
The next one sounds as though it's not a compliant agreement, the prescribed terms should be there, and it sounds as though they are missing, not to mention your missing details.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thankyou. As it has been over a month and I gave them 12 days to respond, should I be sending another letter ?
How will StepChange react if I say I am no longer servicing these debts until I have a CCA ?
One of my debts on the DMP is a student loan grant overpayment which I should have challenged but never did, I want to continue paying this for now until I feel well enough to contest it as I know they will be difficult. Not sure what to do really.
Can I just ask them to pay some of the debts or is it time to go it alone - which I dont really want to do, how do StepChange view CCA processes ?0 -
Well I'm no expert on stepchange policy unfortunately.
I can only go on what others have done, and that's usually to remove the debt from the DMP altogether.
The 12 days to produce a CCA, are only guidelines, as I said it can take a lot longer, by all means send a reminder, but the ball is firmly in their court now.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
