Mobile Airtime Balance, can I challenge this?

Hey all, we recently moved and while waiting for the internet to be switched on a I got a mobile broadband sim card from a Three store. The guy there never explained that if you go even slightly over the allowance the charges would be extortionate. They want £70+ for going 1gb over the limit. I notice in their terms it says you should be emailed or texted a warning that you are about to go over the limit but I never received this. So I was never made aware of this up front and received no warnings. Are there any grounds to challenge or ignore this or is it basically I signed the contract so they can do what they want?

  • This seems like a common sense approach is the first port of call to me. Write to them explaining that you were not aware that you had gone over the limit as you did not receive the warnings that their contract with you said that they would send. Had you had the warning you would of course have stopped using the service...As a result you're not prepared to pay for the extra data used in this situation. Sit back and see what happens... Contracts can work both ways - while yours with them says that you will be charged for data used beyond the allowance, if it also states that you will be warned before this happened, and no warning was received, then it may well be worth a cheeky challenge. (Do check that the details of phone number and email you supplied them with were accurate though!). I wouldn't bother detailing that the person who sold in the store didn't tell you about the potential extra charges as I suspect they will simply say that they weren't obliged to - you should have read the small print (which you did.)

    Thanks that is a good idea. But do you mean write to the DCA or the mobile company itself?
