Eviction looming

been given a reposession date after mounting arrears and not keeping to the suspended possession order given about 5 years ago.

I haven't worked since 2011 but am starting work next month so offered halifaxicon £90 extra a month.
Was told by Halifax a month ago that we could make a payment arrangement but first they needed to get another possession order but not to worry it was cos old one had lapsed.

I then swiftly got a possession date through.
I have liased through Ascent and they won't accept it they want the £9000 arrears.

I have had medical problems and a break down a few years ago and still on medication.
Halifax have all medical notes .
I didn't just have a bit of depression it was very very bad and on a lot of medication.


Update .... I have been harassed by Halifax case management and told I could only do my income expenditure over the phone . I told them I needed to get off the phone as it had been 2 hours. I put in a complaint and Halifax called me back and said I had been treated correctly and it was very grave so I had to be interugated like that . I was offered on the phone all by my case manager to pay £2100 to stop eviction. I said I can only pay £1000 as any more would impact on next months payment.
I really don’t know what to do. If I complain to ombudsman will it delay eviction . I have lots of charges to reclaim. And wanted to get hold of phone calls as I was treated and spoke to appalling

    Have you Engaged Citizen advice bureaux/ Stepchange to help you in terms of money and shelter in terms of housing?


    The bank has been patient with you for the past 6 years, I think if you can't afford the house you are in, it is better to start off with a clean break and hand the keys back in, assuming you own the house and it is not rent arrears


    Your medical history has no bearing on what you owe, you must pay and there is no way round it I am afraid.


    In terms of your phone calls, you may get some compensation, you may not, but you will still have the debt to repay, whether they are rude in your opinion, the debt will not go away.


    The people on the phone have to do their job and ensure you are paying the max according to your incomings and outgoings, interrogation or not, they have to know, otherwise would you prefer a straight repossession? They are trying to work with you

    In a situation like this you should really get in touch with one of the free debt charities ASAP. You can go through a SOA with them for clear guidance about your next steps.


    In short, a complaint won't be good enough to stop the eviction but you can apply to the court to suspend the eviction using an N244 form, this can cost up to £50 to submit but you may get a discount with an EX160. You do need to be able to show the court clearly what you can afford. There is a piece of case law called Cheltenham and Gloucester vs Norgan that states you need to be able to pay the on-going payments, plus enough extra to clear the arrears before the term of the mortgage/ loan ends.


    If you are unable to demonstrate this, then the situation will be harder to resolve and this is why you need to speak to one of the free debt charities. Your health may be taken into consideration by the court, but it does depend what you end up applying for. Good luck,
