probate needed or not

Hi

my wife is an only child and her mother is deceased.

Her father has no property and has named her as sole beneficiary in his will.

All his assets are I believe in cash and are invested is various short term investments. The total value is £160000.

MY wife is a signatory to all his accounts and is named in a durable power of attorney.

When he passes will my wife have to go through probate or will the Durable Power of Attorney cover that

    Enduring? This ceases on death of the donor.

    By virtue of the EPA? Then see above.

    Or do you mean Joint Accounts? In this case, the control of the account passes to the joint account holder.

    You don’t normally need a grant if the estate either:

    passes to the surviving spouse or civil partner because it was held in joint names, for example a savings account

    doesn’t include land, property or shares

    You should contact the organisation holding the money, for example the bank or building society. They may ask for proof of death, for example the death certificate after the death has been registered.

    Each financial institution has its own rules - you may still need to apply for a grant.
