1 year contract placed into another business and being shat on!!!

Would really appreciate some employment advice,

I have a one year contract with a large company, however I've been placed to work within a very large seperate UK business. This is the first time they've both done this. My contract is OK but I work in an office with people who work directly for the company doing exactly the same as me and they have way better perks and basic pay, e.g shift allowance, telephone allowance, our work performance is also ranked alongside each other even though I work for a different company, and the guys who work directly for the company this rank defines a bonus ( which you guessed it I don't get), I'm ranked #5 out of 24 by the way. The difference in salaries works out about £10k more if I had been employed directly!

Honestly I'm super grateful for a job and I really love it! Its just a little bit demotivating to see my colleagues so well looked after doing exactly the same job as me, to the point I'm not even allowed into the staff canteen as an external employee, or to the companies social events. : ( does anybody have any experience of this? I'm being pushed now to work a 6th day a week for my same contract with less than 2 weeks notice.

    Well have you broached them about employing you directly?


    Given you are successful (presumably in a sales role) they would not want to lose you.


    It also depends on the context of your employment, if you are covering a short term absence? Or is this agency work?

    its not a sales role, its an operational role. 3 jobs did come up a few months ago, the company decided to only to recruit internally, I didn't get access to this, they filled 2 positions, then they filled the last position externally, I applied and didn't make an interview! Even though that month and the previous month I was ranked number 2! My feedback was there were stronger candidates although they have nothing but positivity around my work performance. I've started to look for alternative jobs as 6 days on has pushed me, I'm really disappointed though as I really enjoyed it. I've since been told next time they def want to interview me, but when 6 months, 1 year? do I just keep going? I'm loosing it tbh!

    Also I think I'm on a fixed term 1 year contract, employed through a company I have very little contact with.

    With all respect for your - understandable - frustration, you may benefit from considering if your application let you down as opposed to your ability.

    Just because you can (likely) do the job better than the individuals invited to interview - that doesn't mean you communicated that ability better than the other candidates.

    Maybe ask a trusted colleague from the organisation to read over your application and give you pointers on how to score more highly at the next sift? If you have access to the internal recruitment guidance that might also be helpful - sometimes it's a case of 'buzzword bingo'.
    That sounds like a classic case of premature extrapolation.

  • yes i get the buzz word bingo! Yes I defiantly included the companies behaviours, and my application was strong, maybe not as good you're right and I can take that feedback onboard.

    My point is though not about trying to get into the job with the better employment conditions, legally as a fixed term employee is it allowed? i am trying to gain some legal advice and it looks like after 12 weeks employment I could be entitled to the same benefits as if I worked for the company directly.

    I wanted to put it out there to see if anyone has experience of this?

    Seeking legal advice from people on the internet - or basing your actions on the actions of other people with different specific circumstances is an unreliable prospect. I would think you would have to talk to a HR advisor in the company you are wanting to work for - and check your current terms of employment.

    It could be that it's a condition of their contract with your current employers that you can only be recruited via 'fair and open competition' - i.e. be treated as an external candidate - or that you must stop working for all parties for a set period before being directly appointed by the new company.

    I would suggest you are employed as an employee of a company contracting your services to a second party. Because you are an employee you would not gain employment rights with the company you are 'working for' because you are already 'employed' by the one that pays your salary.

    at this stage I'm just researching and gathering information from a variety of sources, including ACAS, citizens advice, I had a meeting today with HR as well as other peoples similar experiences.

    You are a contractor on site, you work to the terms of your employer not the place you work.

    if your employer want you working 6 days a week negotiate a better package from them.

    don't get sucked in acting like an employee of the place you work and doing what they tell you.

    you play the game but don't get drawn into the things like unpaid overtime working weekends and being on their holiday system.

    You are not an agency worker though? So the 12 weeks doesn't apply to you.
  • some great advice guys thank you so much, I managed to negotiate to stay o a 5 on 3 off shift pattern today, I had to put together a business plan and its gone in my favour! YAY
