advice needed

Hi all
i have a couple of questions that i hope i can get some advice on

1) i have received a few letters from a debt company wanting approx £999 for a credit card bill that they say i had from Nat west bank, first of all i have ignored these letters , as i have never taken a credit card out !! i did have a natwest loan that when i lost my job due to ill health was finished via my payment protection, so i would have done the same if i ever had a credit card .... i can only think that my ex husband took this out in my name , i cant prove anything as never saw anything etc. i dont know when this is dated from but im scared to contact them and ask questions in case im near the 6 year limit ..

2) i have received today a letter from working tax people saying again that i owe £1800 approx again with no date of the period that they are talking about, letter states that there debt collection agency have sent this back due to know contact etc, but i have never received any letters regarding this until today !!! ........... again scared to contact if its around the 6 year mark.........

Any advice anyone can give me would be muchly appreciated:o:o:o:

    Hi,

Are these the only two debts you have ?

Maybe posting a statement of affairs (SOA) will help you get some budgeting advice, and also see what options are available to you, link here :

Although tax credit overpayments are subject to the Limitations act, being as its a Government body, they can recover the debt from you in various ways without the need for court action, it can even be deducted from your state pension, or any other benefit you may qualify for now, or in the future, the only way it will be written off, other than by them, is if the debt is included in some kind of insolvency, either Bankruptcy, IVA, or DRO.

You can send the "provit letter" to the debt collector, that orders them to provide proof of the debt, and your liability, it is specifically worded so as not to acknowledge anything, see what they come back to you with, then decide your next move.

Thank you sourcrates for the response, regarding the debt collector is it advisable for me to add that i have never taken out a credit card in my life or leave that till later ? regarding tax credits can they also chase the other named party on the award at that time ie my husband or as it was my claim will be my debt only ?

See what evidence the debt collector produces first, then form a plan to challenge it.

With a joint tax credit claim, any over payment is recoverable from you both, in my case, we were each both liable for half of the debt, so you will be liable for half of what it says in the letter.

They wont tell you that unless you ask them though.
