    If I did get any money, I'd definitely tell the OR, which is why I'm trying to find out his stance before I put in the claim. I'm hoping that he might say it's a one-off lump sum of X amount, so he's going to let me keep it as I've been such a good girl. :)

    Those flying pigs could be worth a lot of money, you should go and grab a net :D

  • Look. I have to be the voice of reason on this.

    Why try and claim back the charges on an account that you handed over to the OR? Do you think that the bank in question is just going to send out a cheque, knowing that it is from a BR account? Of course not - they will make it as difficult as possible - and any cheques rising from the claim will go straight to the OR or trustee, not mailed out directly to you.

    Please, let it go. You have come through something very harsh, and it will do you no good to keep raking over it all. Its gone now

    Bankrupt or not, if the bank in question was not one of WDIAG's creditors, why shouldn't they pay her back her money? I would expect them to pay. Whether or not she gets to keep the money is another matter.

  • Two reasons for asking are:

    a) I already have the statements, so it's not as if it's going to cost me any money to get the information from the banks.
    b) We have all come across anomalies in the way ORs do the job, either from personal experience or through reading of it in forums like this one. Some take everything in someone's account, some don't. Some don't ask BRs to return cheque books & cheque cards, some do. Some allow certain expenditures on SOAs, & some dismiss them out of hand.

    There's no harm in raising the issue with my OR, especially as the bank was not one of my creditors. I don't intend to argue with him whatever his decision is, but surely I'm entitled to ask the question. The ORs do work for the creditors, but by giving me an early discharge they've already decided that any investigation into my finances has finished & they're satisfied with whatever information they got. I've got nothing to lose by asking my OR what the situation would be if I was to submit a claim, & I may find out something that would be of use to other members here. No matter how far we've gone through the process, we can still learn from each other's experiences. If I'd gone down the path of least resistance before, I wouldn't have found out that my OR was willing to let me keep refund cheques when charges were taken out of my account after I went BR, even though others had theirs swiped, & I therefore pushed my bank to give me the money, which they did. I wouldn't encourage anyone to spend money they couldn't afford to pursue something that wasn't going to benefit them in some way. All this is going to cost me is time to check the statements & ask the question, something I have plenty of at the moment.

    Of course - it is not going to cost you anything, go for it. But all charge cases are on hold for the foreseeable until they can agree the new legislation relating to bank charges (and I wonder what side the Government is going to fall on this one?...hmmmmm)

    So yes, if it is just writing a letter and sending statements, great. If it is yet another thing to become embroiled in and stressed about - whats the point? You are in a far more fortunate position than most of the people in the UK at the moment in that you have no debts and a fresh start. Embrace that.

    Bank Charge cases are on hold, but if you are in financial difficulties then the courts will still hear your claim instead of waiting for years for the outcome of the OFT court case.

    100% sure about the bank - I didn't owe them a penny. And I won't be getting stressed doing it, because it's only a bit of adding up out of nosiness to see how much was taken as much as the other reasons I've given. I've embraced my having the letters IPA after my name, but the embrace would be a bit more comfy with a few hundred extra in the bank. Better in my pocket than in the bank's already swollen-to-bursting coffers. :)

    As already said, it costs nothing to ask the OR in question by email and it will stop you wondering.

    I'm 99.99% certain what the answer will be, but "what the hell?".

    The same question has been posted quite a few times (even recently :)) on DQ and DHUK and always with the same answer. But if it doesn't cost to ask from the horses mouth then....?
