Employer not paid my income tax

This is probably the wrong place to post this query but I can't think of anywhere else to ask.

I have been working for my employer for over a year now and I'm just beginning to suspect he has not been paying my income tax or national insurance. I had my suspiscions for a while now and asked him a few times, he just replied don't worry it's all being paid.

He does the pay perosonally rather than give it to the company bookkeeper to do who just types out the payslips. About a week ago the bookkeeper told me he had found out some information that has made him believe no income tax and national insurance has been paid for anyone at the company for the whole of their employment. He has just left the company as a result of finding this out. We are a small company with only 4 employees.

I am now worried, who is liable for the money and how will it effect me?

I was wondering if anyone could help me of direct me to a forum where it would be more appropriate to post this question.

    You need to contact HMRC, they will be able to give you more information x

    It is the employer who is liable for the money (together with interest & penalties once HMRC catch up with them.)

    The only issue for you as far as I can see that you are not getting any credit for paying national insurance when it comes to being eligible for benefits, pension etc.

    this happened to my ex a few years ago

    he was not held responsible in any way for the missed payments, so you'll be ok in that respect

    HMRC however are absolutely toothless & his employer suffered no penalty at all :mad:
    he eventually declared himself bankrupt to avoid having to settle up with the people he owed money to

    I think that (bankruptcy & consequent loss of employment) would be my biggest worry in your situation

    At least I'm no-longer worried about having to pay a huge bill. Hopefully this applies to my tax credits which I've been receiving, while paying no tax.

    I'm pretty sure the employer will go for bankrupcy if he can, the company is not trading too well. I'm leaving as soon as I get last month's pay cheque and it clears. This is my main worry, I'm becoming increasing sure it will never come. Hence wishing to have the threat "I will report you to the HMRC" to get it out of him.

    He also an accountant and member of a professional body, so I not sure if bankrupcy will effect his membership.

    Bankruptcy and not paying HMRC will get him struck off, I would think, and rightly so.

    I wouldn't be surprised if he wasn't a member of a profession body at all.

    To check whether Your N I contributions are up to date you can get a pensions forecast online.

    Go to https://secure.thepensionservice.gov.uk/statepensionforecast/

    It will tell whether any years are missing, if any problems you can ask them to investigate.

    The employer is responsible for paying the employee taxes under the PAYE system. Employer can get fined or even imprisoned to enjoy the showers in HM Prisons.

    Provided you have a payslip that states that NIC and PAYE have been deducted by your employer, then HMRC will accept that you have paid these contributions. If you still feel a bit worried, write or ring HMRC and ask them. Any comeback will be on the employer, not the employee.
