Flexible working: Am I being pedantic?

    9.00am - 5.30pm = 8.5 hours

    8.5 x 5 = 42.5 - with no lunch hours

    8.5 - 1hour lunch = 7.5. x 5 = 37.5 hours

    Are you actually working 42 hours per week?

    If we were required to support a request in the evening or out of hours (rarely happens), then they'd give you time back in lieu to use for a half day etc. But if they asked you to stay 3 hours later to finish something off then you wouldnt be entitled to a half day off. Wishy-washy I know.

    LOL I hear you - there have been a few alarm bells along the way and I'm not loyal to the job was just sounding-off to see if im being diddled in some way and want to play it by the book.

    And yes its a 37.5 hour contract with 1 hour lunch on top but in most places I have worked you are required by law to take 30 mins (and thats what you get paid for) the other 30 is optional and thus was using it somewhere else.

    Maybe its time for a new job, rather than chasing 30mins here and there :)

    They can remove flexible lunch option and insist on 1hr but you said they still have flexible start end so if you want to leave earlier, start earlier.

    Extra hours and TOIL are a separate issue to resolve

    age dependant - so safer for an employer to insist on 30 minutes


    - and the law doesn't force an adult to actually take a 20-minute break for lunch, it's just an entitlement, but an employer can insist

    The law is one thing, but organisation can apply whatever lunch hour they want as part of their policy. As a matter of fact, they could justify that imposing one hour lunch break is a health and safety benefit so that staff can take time away from the screen which is a good thing.

    What band are you? Above 7, it is common to be expected not to be paid for extra hours and from what I understand, most managers do a lot more than their 37.5 contracted hours.

    Flexible time also doesn't mean coming and going as you wish, making up hours when it suits etc... it can mean agreeing on a start/finish time that could be different to other staff with core hours, however, whatever is agreed is what it is every day.
